Releasing a Memorandum of Land Contract in Nebraska is important because the memorandum is a public record that signals an equitable interest in the property. If it’s no longer valid—due to payoff, default, rescission, or other reasons—it needs to be formally released to prevent legal and transactional problems.

Reasons for release:

1. Removes Cloud on Title
A recorded memorandum creates a noticeable lien-like interest in the property.
If not released, it may block:
Sale or refinance by the seller
Title insurance issuance
Transfers to third parties

2. Prevents Future Legal Disputes
Without a release, future parties (buyers, creditors) may believe the land contract is still active.
The buyer or seller could face false claims, lawsuits, or delays in transactions.

3. Clarifies Contract Termination or Fulfillment
Confirms that the land contract has:
Been satisfied (i.e., paid in full and deed delivered)
Cancelled or rescinded
Terminated due to default or abandonment
Makes the termination part of the public record.

4. Protects the Seller
Prevents a buyer from later claiming ongoing interest or breach. Frees up the seller to sell, lease, or finance the property again.

5. Protects the Buyer
If the buyer walked away or defaulted, recording a release formally cuts off future responsibility.
Prevents confusion about taxes, liens, or legal obligations tied to the land contract.

I am generally pleased with your products. However, I found it difficult to return to the package after accessing one selected document. One other comment: Your Trustee's Deed package should include a Certificate of Trust form.

Really solid system for determining what may prevent your documents from being accepted. I love the comments section allowing for fluid communication. I only wish there were automated emails for all those communications and once documents were accepted, but I did receive a couple personally-generated emails regarding the progress instructing me to check the site.

Easy to use and comprehensive in content. Would recommend to anyone that is looking for a cheaper alternative to a lawyer. (They hate services that cut into their business)
