A Lis Pendens Notice is filed when actions are brought that affect title to real property. Typically by the Plaintiff (or in case any defendant sets up an affirmative cause of action and demands relief which shall affect the title to real estate, he or she may, at the time of filing such answer or at any time afterwards, file with the clerk or register of deeds of each county in which the real estate thus to be affected, or any part thereof, is situated, a notice of the pendency of such action.) (NRS. 25-531)
(From the time of filing such notice the pendency of such action shall be constructive notice to any purchaser or encumbrancer to be affected thereby. Every person whose conveyance or encumbrance is subsequently executed or subsequently recorded shall be deemed to be a subsequent purchaser or encumbrancer and shall be bound by all proceedings taken in the action after the filing of such notice to the same extent as if he or she were made a party to the action.) The Lady Bird Deed appears to be fine with me as are the instructions. However, there apparently are no specific laws in Texas addressing them other than they are OK. The problem is that lenders are surely going to use them as triggers for their due on sale clauses, especially as the current small mortgage rates begin to increase. The solution to that seems to be to sign and have them notarized, but not to record them unless the holder needs to enforce the provisions. It seems to me that you should consider your solution to that problem in your instructions.

It is easy to use but difficult to know when the document has been reviewed for recording and when the invoice is ready. It would be helpful for the website to send an email automatically once the document(s) are ready to be recorded to let you know what the time line is.....Thank you for your help.

Deeds.com recorded documents for me without any issue. It's a good service and provides a lot of assistance on its web site. However, I asked for a printed receipt (i.e. an pdf copy of one), but after a staff provided me with an obvious answer, they simply ignored my follow up requests. I also asked a simple formatting question that they should have been able to answer; instead, they passed the buck and referred me to the recorder, which currently is a very time-consuming venture. They also have no telephone number for any issue. Generally, the service saves me the time and effort of physically recording a document, but when you think about $19.00 per recording seems like a steep price for the services rendered.

Deeds.com was such a blessing in order for me to get something done that my lawyers could not get done. Transferring a mineral right from my deceased parents to me and my husband. The mineral company person I worked with went above and beyond helping me fill the paperwork out perfectly so that it had “right of survivorship” (and other things phrased properly) so that either my husband or I won’t have the issue I have had.
