As part of the New Mexico Statutes, the beneficiary of an interest in property may renounce the gift, either in part or in full (Uniform Disclaimer of Property Interests Act NMSA 1978 46-10-1 to 46-10-17). Note that the option to disclaim is only available to beneficiaries who have not acted in any way to indicate acceptance or ownership of the interest ( 46-10-13).
The disclaimer must be in writing and include a description of the interest, a declaration of intent to disclaim all or a defined portion of the interest, and be signed by the disclaimant ( 46-10-5 (c)).
Deliver the disclaimer within nine months of the transfer (e.g., the death of the creator of the interest) to the personal representative of the decedent's estate or the trustee, or file it with the court having authority to appoint such a person or to enforce the trust ( 46-10-12). If real property is involved, record a copy of the disclaimer in the office of the county clerk in the county in which the property or interest disclaimed is located. This helps avoid any ambiguity regarding the chain of title ( 46-10-15).
A disclaimer is irrevocable and binding for the disclaiming party and his or her creditors, so be sure to consult an attorney when in doubt about the drawbacks and benefits of disclaiming inherited property. If the disclaimed interest arises out of jointly-owned property, seek legal advice as well.

The paperwork/forms are fine, but there isn't enough explanation for me to figure out how to file the extra forms (which I do need in my case). The main form, Deed Upon Death is fine. I think the price is pretty high for these forms. I wouldn't have purchased it because there are places to get them for much cheaper (about 6 dollars), but this site had the extra forms I wanted (property in a trust and another form). Unfortunately these were included as a "courtesy" and there are no instructions for them. So three stars for being clear about what was in the package, having the right forms that I need, but instructions for putting them to use and price took a couple of stars off. Downloading was easy and once you download you can type the info into the PDF--that makes working with the forms much easier.
Thank you for the feedback Maria. Regarding the supplement documents, it is best to get assistance from the agency that requires them. These are not legal documents, they should provide full support and guidance for them.

I thought the instructions could have been a little better. I didn't know how to do this if the spouses are married but living in separate residences. Also I didn't understand the "Prior Instrument Reference". That should be explained better. Very sketchy instructions.

I used the Oklahoma Gift Deed transferring property intra-family, and found it easy to complete. I could not find an Oklahoma Affidavit for the new law re citizenship verification, 60 O.S. Sec 121 and found it at another site that was not a fill in online. Oh well. Site was easy to navigate.

The Deed of trust form was fine but the promissory note was less user friendly since I needed to change a few things that were fixed in the template. I ended up using white-out after I got no response when I emailed the help site that was provided in one of your emails, so it looks a little odd but should be usable

The purchasing process was very slick and my credit card was charged IMMEDIATELY. The deliver went well as the link was provided immediately. However I asked a question via the "Contact Us" link and days later I get a survey but no reply. I may have been directed to the wrong forms via my County and I wanted to confirm that...but still no answer. What would that deserve as a rating???
