A mortgage is a conveyance of title to property that is given as security for a loan until the grantor (borrower) repays the lender according to terms defined in an attached promissory note. It contains a lien against the security property that ends when the debt is repaid.
Use this form for financing real property- residential, rental units, condominiums, vacant land, small commercial and planned unit developments.
Mortgage covenants
Transfer of Rights in the Property. The Mortgagor hereby mortgages to the Mortgagee the Property described in this Mortgage. Mortgagor can lose the Property for failure to keep the promises in this Mortgage.
Applicable Law. Mortgagee shall have all the rights set forth in Section 254 of the New York Real Property Law in addition to Mortgagee's rights set forth in this Mortgage, even if the rights are different from each other.
Non-Judicial Foreclosure. Mortgagee shall have the power of sale under Article 14 of the Real Property Actions and Proceedings Law, as it may be amended from time to time, and under any successor statute or statute of similar impo1t and effect which may subsequently be enacted providing for non-judicial sale of the Property, subject to the requirements and restrictions applicable to such statutory process.
Promissory Note
A promissory note is a negotiable instrument that contains an unconditional written promise, signed by the borrower, to repay the lender or its designated agent. The promissory note also defines the amount and specific terms of the loan between borrower (maker) and lender (payee/holder).
The promissory note is not recorded on its own. Instead, it is presented for recording along with its related deed of trust or mortgage.

If I hadn't spent my career as an escrow officer (albeit in another state), I may have had a hard time figuring out exactly which deed I needed and how to prepare them, even with the back-up informational, how-to pdf documents, without an attorney. My experience speaks to how much the general public doesn't understand and how confusing it can be. I downloaded the Lady Bird deed. The process was quick and easy to download. Just select your county, fill out the form. You will need the property description from your original deed. In my case I had to go downtown Wayne County (Detroit). (Make an appt online). 1st you will have to get the property tax certified to ensure all taxes are paid to date (5th floor at the Wayne County Treasurer office). Give them the form you just filled out and they will stamp certified $5. After that take the form to the Register of Deeds (7th floor) appt needed. $18. Make sure it is properly notarized and all signatures completed. Once approved, they will scan it, stamp it, give it back with a receipt and mail a copy also. All Done. Worked beautifully. My co worker go a lawyer and paid over $250. I just used deeds.com and total for forms and going downtown with notarizing was less than $40 Yea!

I am a lawyer and purchased a specialized type of deed for a special scenario. The product received was functional, but not great. Wording is slightly clunky and the form layout was not convenient for making a professional final product. The wording also didn't contemplate a remote-state probate, which is a common scenario. Something about the PDF prevented me from doing cut and paste, so I had to do OCR to get the relevant text for inserting in my existing draft deed. Finally, while the site claims it is customized for the exact state and county, it does not appear to be well-customized for that purpose and I had to use other language (not sourced from the deeds.com document) to meet local norms.
