A grant deed can be used in North Carolina to transfer title to real property. This type of deed falls between a warranty deed and a quitclaim deed.
In a grant deed, the seller (grantor) warrants that the property is free from any encumbrances except those that have been previously disclosed to the buyer (grantee). The seller also guarantees that he does in fact hold title to the property and has the right to convey it to the buyer.
A grant deed must be signed and properly acknowledged by the grantor before an officer authorized by the state to take acknowledgments of deeds. Section 47-38 of the North Carolina General Statutes provides an individual form for acknowledgement by a grantor. If a deed has been executed and acknowledged in a state other than North Carolina, the deed must conform to North Carolina law in order to be recorded in this state. Grant deeds must be executed and acknowledged in strict compliance with the North Carolina acknowledgment provisions in order to be recorded and to provide constructive notice.
North Carolina has a pure race recording statute. No conveyance of land in this state will be valid to pass any property interest as against lien creditors or purchasers for a valuable consideration from the donor, bargainer, or lesser but from the time it is registered in the county where the land lies, or if the land is in more than one county, until the conveyance is registered in each such county. Unless it is otherwise stated on the grant deed or on a separate registered instrument executed by the party whose priority interest is adversely affected, instruments registered in the office of the register of deeds will have priority based on the order of registration as determined by the time of registration. If instruments are registered simultaneously, then priority is determined by the earliest document number set forth on the registered instrument or the sequential book and page number (47 18).

While it's nice to get all the forms and info in one package for a reasonable cost, the fixed format of the form does not allow for a lengthy meet and bounds property description for real property. Also, the Cover Sheet has big fillable sections with no instructions about what's supposed to go there. I tried the "Contact Us" link, but all it does is spin saying it's trying verify the security of my connection. Looks like I;m going to have to create my own deed in MS Word instead of just filling in the blacks of the PDF file that I downloaded. Bummer!

It's useful to have forms specific to the County as well as the State. The examples are also helpful, but it would be even more helpful to see an example of a complete and successfully filed package. I will go the County Recorder's Office to see if I can find an example there.

This is the first time that I have used this service. An employee at the Clerk and Register office in Arizona suggested that I try Deeds.com to find the form I needed and the county office could not provide. I am a licensed Realtor in Colorado with a 43-year career and this service has not been necessary in my own state but it was extremely helpful in finding a form in Arizona. These forms made it so easy to update the property deed and the instructions and sample filled out form were most helpful. You might want to add some brief information on when or why to use the Acknowledgment in Individual Capacity notary form. In my case the notary was required to use it but also filled in the brief notarize section on the Affidavit as well. She said the one on the Affidavit had some value because it showed she had witnessed the my signature. But this was only after I suggested both be filled in as she initially thought to just strike through it and just use the Acknowledgment in Individual Capacity form.

Not knowing I could down load these forms, I first went to the local recording office thinking I could get info on the forms I needed. I was told that obviously you dont know what you are doing so find someone who does. This snippy clerk obviously didnt know the forms were accessible on line; either that or she was needing to feel her phony superiority.
