A Notice of Contract is not mandated by the North Carolina lien code, although a prime contractor may want to file and post a Notice of Contract because it offers additional protection by reducing the possibility of double payment. The Notice must be filed and posted within 30 days from the issuance of the building permit. N.C.G.S. 44A-23.

A second or third tier subcontractor will be prohibited from enforcing a lien when a contractor when the Notice is posted on the property and filed with the Clerk of the Superior Court.

The Notice includes: (1) the name and address of the contractor; (2) the name and address of the owner of the real property at the time the Notice of Contract is recorded; (3) a general description of the real property to be improved (such as street address, tax map lot and block number, reference to recorded instrument, or any other description that reasonably identifies the real property); and (4) the name and address of the person, firm or corporation filing this Notice of Contract. N.C.G.S. 44A-23(b)(2).

After some initial general confusion -- (we sold a small piece of land privately and therefore do not typically prepare such documentation (!)) -- we were able to purchase and download all forms from Deeds.com and understand how to complete it/them. The help is all there, we just needed to read and study it - the "Example" helped alot. We were able to complete the Document per your online form(s) and then take it to be signed/notarized - and take the completed paper document to the Registry -- and it is now all registered and we are All Set. rn Took the morning (only). We have been waiting for a Title Company to put a release of Lien together for the past 3 months. I figured it was taking way to long and decided to use template here instead. In less than hour I was able to add all the information on the template and provide forms to our Seller to use. We were buying and he didnt think they were necessary. But I refused to pay him in full until he agreed to sign papers at the bank, and of course in front of a notary. We turned around and filed the Release of lien paperwork at County Clerks office, we officially own our house. Thank you!
