This Oregon Warranty Deed (Individual Grantor) is a statutory warranty deed under ORS 93.850, set up for one person who holds record title alone and conveys Oregon real property with full covenants of title. The form recites a single grantor, carries one signature line, and closes with one notarial acknowledgment certificate in the Oregon short form. It is the configuration a sole owner of record presents: one name on the current vesting deed, one name signing before the notary.

A warranty that reaches the whole chain of title

Oregon writes its deed vocabulary into statute. When a deed states that the grantor conveys and warrants the property to the grantee, ORS 93.850 attaches four covenants that run with the land: that the grantor is seized of the estate the deed purports to convey, that the grantor has good right to convey it, that the property is free from encumbrances except those specifically set forth on the deed, and that the grantor warrants and will defend the title against all persons who may lawfully claim it. Those covenants reach the property's entire history, not just the grantor's own years of ownership, which is what separates a general warranty deed from Oregon's special warranty, bargain and sale, and quitclaim forms. The deed also conveys the grantor's entire interest at its date, estops the grantor from later claiming a smaller estate passed, and carries after-acquired title. Because the covenants except only what the deed itself lists, the exceptions section, completed from a current title report or the recorded documents, defines exactly what the grantor stands behind.

Built around one owner of record

The grantor section recites one individual with a mailing address and, in common Oregon practice, a marital status recital. One signature block and one acknowledgment certificate follow, so a single trip before the notary completes execution. A sole owner selling a house, an unmarried owner transferring an investment parcel, and a former spouse conveying property awarded in a dissolution judgment present the single-owner pattern this deed recites. The form is not set up as a co-owner conveyance, an entity or trustee conveyance, or a conveyance signed under a power of attorney; those configurations carry different recitals and certificates. Oregon abolished dower and curtesy decades ago, and no Oregon statute located requires a non-titled spouse to sign a lifetime conveyance merely because the property is a marital residence, so the deed's single signature line reflects how a sole-title conveyance is executed in Oregon.

The statutory statements on the deed's face

Oregon law scripts several parts of a fee-title deed. ORS 93.030 requires the true and actual consideration for the transfer, stated in dollars, on the face of the deed, and the county clerk may not accept the deed for recording without it. ORS 93.040 requires a land-use and property-rights statement in the body of the instrument, and ORS 93.260 requires the sentence directing where property tax statements are sent. This form carries all three verbatim, and it places the items ORS 205.234 assigns to the first page, the transaction name, the parties, the return address, the consideration, and the tax-statement address, on the first page, with the top of that page held clear for the clerk's recording label.

Recording with the county clerk

The deed is recorded with the county clerk where the property is located. Oregon is a race-notice state under ORS 93.640, so recording protects the grantee's priority against a later purchaser. Formatting follows ORS 205.232: paper no larger than 8.5 by 14 inches and type no smaller than 10 point, standards this form meets. Fees vary by county under ORS 205.320 and each clerk's schedule. Oregon collects no statewide deed transfer tax, and local transfer taxes are barred with one grandfathered exception, Washington County's tax of one dollar per thousand of the selling price, paid or exempted within 15 days of recording there.

The deed form is hard to fill in. There is no way to fill in the county in the "reviewed by" section. Also, there is no place for the Grantee's address on the form. I had to include it in the fill-in space for the legal description.

Website is easy to use. I ordered the form, filled it out and uploaded it for recording. My only critique is that you can't preview the form before ordering and paying for it. I ordered a Deed of Full Reconveyance form only to find out I needed the Substitution of Trustee and Deedn of Reconveyance form instead. So I wasted $22 on the wrong form.
