Questions answered? Let's get started!
In Pennsylvania (PA), an Installment Land Contract is a form of seller financing where the buyer makes payments toward the purchase of property, but legal title remains with the seller until all payments are made. A Full Release of Installment Land Contract would signify that the buyer has completed all payment obligations and is entitled to full ownership of the property.
Here’s a breakdown of the form, as well as the codes, laws, and statutes that might affect the release:
Key Elements of a PA Full Release of Installment Land Contract Form
Parties:
Seller (Vendor)
Buyer (Vendee)
Property Description: A detailed legal description of the property, including address, parcel number, and any other identifiers.
Contract Date and Installment Details: The date the installment land contract was originally signed, and a reference to the payment terms.
Statement of Satisfaction: A clause that acknowledges that the buyer has fulfilled their payment obligations under the original contract.
Release of Interest: A statement in which the seller releases all rights, claims, and interests in the property, transferring full ownership to the buyer.
Recording: The release should be recorded with the local county recorder’s office where the property is located to give public notice that the installment land contract has been fully satisfied.
Relevant Pennsylvania Codes, Laws, and Statutes
Installment Sales Contracts:
Pennsylvania law recognizes installment contracts, but there are no specific statutory provisions in the Pennsylvania Code dedicated exclusively to installment land contracts. However, they are generally governed by contract law under:
Pennsylvania Uniform Written Obligations Act (68 Pa. Stat. § 250.201): This law supports the enforceability of written contracts, such as an installment land contract.
Statute of Frauds (33 Pa. Stat. § 1): Requires contracts for the sale of real estate to be in writing and signed by the party to be charged, making it relevant to the installment land contract.
Real Estate and Property Law:
Pennsylvania Real Estate Licensing and Registration Act (63 P.S. § 455.101 et seq.): Regulates real estate transactions and is relevant if a licensed broker or agent was involved in the installment sale.
Title Transfer Laws (21 P.S. § 621 et seq.): When the installment contract is satisfied, the full transfer of the title must follow PA’s general procedures for real estate transfers.
Recording of Documents:
The recording statutes in Pennsylvania ensure that real estate documents like deeds and installment contracts (and their releases) must be recorded in the appropriate county recorder's office to establish a public record.
21 P.S. § 351 (Recording of Deeds and Other Instruments): Specifies that all deeds, conveyances, and agreements (like installment land contracts) affecting real estate need to be recorded.
Consumer Protection:
Unfair Trade Practices and Consumer Protection Law (73 P.S. § 201-1): If an installment land contract was entered into with deceptive practices, this statute provides protections for the buyer.
Default and Foreclosure:
If the buyer defaults before fully satisfying the installment contract, the seller may initiate a foreclosure-like process to regain possession of the property, but the specific procedures will depend on the terms of the contract.
Statutory Considerations for the Release:
Tax Implications: Upon full release, the buyer may need to ensure that all real estate taxes and transfer taxes are accounted for.
72 P.S. § 8101-C (Realty Transfer Tax Act): A transfer tax might apply when full title passes to the buyer after the fulfillment of the contract.
Zoning and Land Use Laws: Local zoning laws may affect the property's future use after the full release. Buyers should ensure compliance with any local zoning requirements.
Recording Costs: Fees for recording the full release document vary by county and should be paid at the time of filing with the recorder’s office.
Conclusion: A Full Release of Installment Land Contract in Pennsylvania legally transfers full title of a property from a seller to a buyer after all obligations have been met under the original contract. It is subject to the general principles of contract and real estate law, requiring proper recording to ensure clear title. Key Pennsylvania statutes, such as the Statute of Frauds, Recording Statutes, and Title Transfer Laws, affect the validity and execution of the release.

Easy to download and use the forms, however two forms needed for my county recording were not included.
Thank you for your feedback Frank. We'll look into finding and including the additional supplemental documents. Sometimes supplemental documents have to be generated by the county's system, specific to the transaction.

Great service - it was my first time using the service and really recommend it. Due to COVID-19, my County Recorder's Office is closed and I was able to create the document using their vast templates, notarize it, and upload it into the system. The recording process took about 7 working days which is not bad considering that most people are working remotely. I will share this website and its many resources with my relatives and friends.
Thank you Griselle, glad we could help.
