Section 30-5-30. Requirements for recording of instruments.
This section outlines the general requirements for recording any instrument affecting real estate.
Text: No deed, contract, or other instrument in writing required by law to be recorded shall be recorded unless it has been executed in the presence of, and subscribed by, two or more credible witnesses, or acknowledged by the grantor, or proved in accordance with the provisions of law.
Section 30-5-35. Indexing of real property instruments.
This section discusses the indexing of recorded instruments, which is essential for public notice.
Text: All instruments conveying an interest in real property or any interest therein shall be indexed in the grantor and grantee indexes in the office of the register of deeds or clerk of court in the county where the real property is located.
Section 30-5-40. Recording of documents affecting title to real property.
This section specifies the types of documents that can be recorded.
Text: Any deed, contract, or other instrument in writing which conveys, encumbers, assigns, or affects title to real estate or any interest therein, and which is required by law to be recorded, shall be recorded in the office of the register of deeds or clerk of court in the county where the real estate is situated.

The "Trustee's Deed" should have been labeled a Deed of Trust because that's what it really is. So now I just wasted $19.97 getting something I can't use.

If I hadn't spent my career as an escrow officer (albeit in another state), I may have had a hard time figuring out exactly which deed I needed and how to prepare them, even with the back-up informational, how-to pdf documents, without an attorney. My experience speaks to how much the general public doesn't understand and how confusing it can be. Nonetheless, the access to so many documents at a fairly reasonable cost, the basic how-to docs made available along with the purchased doc makes all the difference. Order Process: 5 Stars - very easy Material Received: 2 Stars Issues: 1. Printing- Document would not print in format displayed. Format would continually shrink to approx 2/3 size thus not useable for formal doc submission to County Records office. 2. Document Format- Data insertion fields (addresses) were not of correct size for data input. I needed a 4 line input space but was limited to only 3 lines. Also, Date field (year) was mis-oriented in-so-much that the 3rd digit (inputted) overlapped on 2nd digit (pre-printed) and also was of noticeably different font. 3. Useability- Hand-written input space provided (for Notary) was deficient in space and spacing. It was a challenge to utilize the space available to complete fully and maintain legibility. Overall - the document worked marginally as advertised, I did need to re-write the entire document myself. It is a good concept but I'd recommend that Deeds company improve the downloaded forms for actual useability, readability, functionability. regards, Jim S
