Once the underlying contract is satisfied, terminated, or otherwise no longer in effect, it is essential to release the memorandum of record.

Common reasons to release a Memorandum of Contract for Deed in South Dakota:

1. The contract has been fully performed, and the deed has been delivered and recorded.

2. The contract has expired without full performance.

3. The contract has been canceled or terminated, whether by mutual agreement or default.

4. The memorandum was recorded in error or relates to an offer that has been withdrawn.

Failure to record a release may result in a “cloud on title,” hindering the seller or buyer from subsequently selling, refinancing, or insuring the property, as the memorandum constitutes a recorded claim against the property.

My sale is a land contract and it is complicated. We were thinking we'd have to get an attorney. Your site is very thorough and helpful. Was driven to this site by the county website. It took a bit of work having to create an account, etc. The example was useful; however the example only showed both parties in the same county, nor did the instructions mention anything about differing counties. This caused an oversight on my part.
