The affidavit of heirship, sometimes called an affidavit of inheritance, is a statutory form under T.C.A. 30-2-712.
An affidavit of heirship, when recorded, gives notice of a change in title following the death of a real property owner. It is typically recorded when the decedent has died intestate, or without a last will and testament. The affidavit names the decedent and the heirs who, by operation of law, are the current owners of the property.
The affiant, or person making the sworn statements contained in the affidavit, is anyone having knowledge of the facts contained within. A standard affidavit of heirship contains the legal description and map parcel number of the realty and lists the heirs by name, address, and relation to the decedent.
In addition, if not followed by a recorded deed from one or all heirs, the affidavit requires the tax bill address for tax statements on the property and a prior title reference stating the type of document and book, page, and recording date of the instrument granting title to the decedent.

The form was useful, however the formatting is terrible once completed. A lot of white space with no option to remove extra spacing or to improve the overall formatting.

I am so glad I found this resource! As the Executor of a family members estate I wanted to save money by bypassing a lawyer as it seemed pretty straight forward to tranfer a Life Estate to the remainderman. (I had original deeds). But talking with 3 different states and 4 different counties - none of which seemed to need the same documents, I was almost ready to dump this in a lawyer's lap. This resource makes it simple!

The deed itself was easy. I did notice that although the website says that the deed would exempt the house from probate, the deed clearly states that it might not. I hope that "might " is the operative word here.

I didn't care for it because I was having to do other things in between filling it out and all of a sudden it would not allow me back in it to make changes. Luckily I had saved it and then had to do FILL/SIGN option which looks ugly but that was the only way I could add what I needed.
