The affidavit of heirship, sometimes called an affidavit of inheritance, is a statutory form under T.C.A. 30-2-712.

An affidavit of heirship, when recorded, gives notice of a change in title following the death of a real property owner. It is typically recorded when the decedent has died intestate, or without a last will and testament. The affidavit names the decedent and the heirs who, by operation of law, are the current owners of the property.

The affiant, or person making the sworn statements contained in the affidavit, is anyone having knowledge of the facts contained within. A standard affidavit of heirship contains the legal description and map parcel number of the realty and lists the heirs by name, address, and relation to the decedent.

In addition, if not followed by a recorded deed from one or all heirs, the affidavit requires the tax bill address for tax statements on the property and a prior title reference stating the type of document and book, page, and recording date of the instrument granting title to the decedent.

Unfortunately for me this website was of no help, due to the amount of paperwork that needed to be submitted. One thing I can say they responded with answer really quickly. If this is a website that only deals with quick and fast deed issues, then it should indicate what they can and cannot do.

Well worth the $20.00 for the Transfer on Death Deed, if you are willing to do the leg work to notarize and record the deed. Money well spent and money well saved. The value is in the short, bullet type instructions and State specific forms and requirements.

In Colorado a Release of a Deed of Trust without the original note must be efiled - the Recorder said it had to be Simplifile or CSC Global neither of whom are designed to do a 1 off filing (you have to subscribe). Fortunately, I found Deeds.com - they were great. helped me work through a couple clerical issues and it is done. I am so happy and pleased. I would give them more stars if I could. I will spread the word among the realtors and title companies who couldn't help that there is a better option.
