A durable power of attorney designates in writing an agent (attorney in fact) and contains the words. (This power of attorney shall not be affected by subsequent disability or incapacity of the principal, or This power of attorney shall become effective upon the disability or incapacity of the principal, or similar words showing the intent of the principal that the authority conferred shall be exercisable, notwithstanding the principal's subsequent disability or incapacity.) (34-6-102.)
This instrument offers three choices for effective dates.
1. Immediately
2. Upon incapacity
3. Immediately when my spouse is acting as my Agent. If my spouse declines, is unable or ceases to serve as Agent, this Power of Attorney becomes effective upon my becoming disabled or incapacitated.
In the event your agent is unable or unwilling to serve a (substitute Agent) is named.
When the principal is (disabled or incapacitated). All acts done by the agent (attorney in fact) (bind the principal and the principal's successor in interest as if the principal were competent and not disabled.) 34-6-103
In general, if the attorney if fact acts under the power of attorney, he/she has a duty to account to the principal, or any legal representative. 34-6-107
This Durable Power of Attorney states: Pursuant to T.C.A. 34-6-101 et seq. and T.C.A. 34-6-201 et seq. (collectively the "Law"). I intend for the Law to apply in all respect and for this instrument to be construed broadly and not narrowly.

Thought from the reviews and claims, it would be able to do our quit claim deed. Maybe for simple situations it works but ours required more room for the description and parcel numbers. Ended up being a total waste of $40.00. Wouldn't buy again. It is no better than the free forms you can find online.

To clarify for other customers: our quitclaim deed package includes an exhibit/attachment page for legal descriptions and parcel numbers that run long, with instructions on when and how to use it, this is a standard approach for multi-page legal descriptions and is accepted by recorders.

The Oregon TODD transfer on death deed template worked great and was easy to use. They had instructions and a guide that had good pointers to filling everything out. It took about 2 weeks to mail in my filled TODD and receive it back from the county with their stamp. Would definitely use this service for other documents

I called the county clerk office yesterday that i wanted to get a deed e-filed and recorded. I was told they are not accepting documents in person because of the COVID 19 pandemic that I have to mail it. I found Deeds.com online and in less than 24hrs i have my document. I was not able to use the form after paying for it. The words in red would not let me type over them and I could not get a blank document. Useless.
Each forms package includes a blank form, a guide, and a completed example. The red text appears in the completed example to show how a finished document may look; the blank form is the editable document intended for customer use. Because our products are do-it-yourself legal forms, we canceled the order and payment when it was clear the customer was not able to identify and use the blank form included in the package.
