Using an Indemnity Agreement to Protect from Liens in Tennessee
Property owners can protect themselves from a mechanic's lien on their land by executing an indemnity agreement binding both the contractor and indemnity company. By entering into an agreement, the insurer agrees to pay the contractor any amount that could otherwise be enforced through a lien placed on the property. This way, the contractor will turn to the insurance agency and not the land owner for any deficiency that is owed.
This indemnity agreement is designed to be used by contractors and material providers as well as property owners. We have been waiting for a Title Company to put a release of Lien together for the past 3 months. I figured it was taking way to long and decided to use template here instead. In less than hour I was able to add all the information on the template and provide forms to our Seller to use. We were buying and he didnt think they were necessary. But I refused to pay him in full until he agreed to sign papers at the bank, and of course in front of a notary. We turned around and filed the Release of lien paperwork at County Clerks office, we officially own our house. Thank you!

Forms used, created quitclaim deed that the county accepted without a second look (turns out they see deeds.com forms regularly via erecording and in person). Will be back for any real estate related forms I need and they carry. Will always be my first stop. Also, will use erecording next time, mad I didn't see it this time.

The download of forms, etc. was easy and the guides that were provided were good, but more information would have been nice as to where to find tax map #, parcel #, and district mentioned in Exemptions from Property Transfer Fees (and Declaration of Consideration or Value. In general, I was quite pleased with your product.

The information and instructions provided is thorough and great. But, the fill-in-the-blanks form does not work well and is very frustrating. The font size of the information I was adding on each individual line varies and is determined by the number of characters entered on that individual line. So the font size is different on each line. And the number of lines is fixed making it impossible to fill in the full legal name of the trust I needed to fill out the form for. My needs are somewhat unusual, but the form should have been designed to be flexible enough to handle it. A blank paper form would have been more useful.

I am still in the trial stage. I am an older lawyer. Any help I can get is worth it. Once you get used to the format and data fill in the deed thing is excellent. Very professional if not a little slow. I have only done three deeds in one state so I will have to see how it goes. I like the product and their attitude towards pleasing the customer.
