A certification of trust is a document that contains relevant details about an established trust containing real property. It is governed by Texas Property Code Sec. 114.086. A certification of trust validates the existence of the trust by identifying its full name, the date it was established, the names of the settlor (grantor) and trustees, the trustees' powers, and other details as needed. This is important because it allows the actual trust agreement, which is generally not recorded, to remain private.
The form is executed by the trustee and signed by the trustee and grantor (who can be the same person) and recorded in the office of the county recorder in any Texas county in which all or a portion of the real property is located. In order to facilitate a transfer of real property into a trust, financial institutions may require the trustee to furnish a certification of trust. In addition, third parties may request a certification of trust to confirm the trustee has the authority to transfer real property out of the trust.

Very good information. Easy access and easy to download. All the forms needed for TOD to be notarized and recorded with the county office. Much better than working with a Trust and the expense of lawyers, especially when several parties are involved and the owner of said property knows exactly to whom the property should go. Having forms and instructions available for the public to have their wishes recorded and confirmed makes handling final planning much easier and prevents family members from having the unnecessary task of going through court to solve property distribution issues. Overall positive experience; especially liked immediate access to downloaded documents and instructions. My only concern was lack of adequate space in portions of your beneficiary deed blank form which then required me to use 3 exhibits to complete all necessary documents for the county recorders office. The process was easy going. The process is one thing, the results another. I have attempting to resolve this matter, of claiming sole ownership of the property for several YEARS. I lost my Bride of 65 years in 2015. A lawyer I hired failed in his attempt, so I'm waiting to see the actual results.
