This form is executed/signed by the borrower/Assignor as inducement for the Lender/Assignee to make the loan evidenced by a Note secured by a Deed of Trust, borrower/Assignor has agreed to an assignment of rents in accordance with Chapter 64 of the Texas Property Code to Lender/Assignee in, to and under any and all leases (hereinafter collectively referred to as the "Leases" and singularly as a "Lease") and any rights to receive payments and liens securing rights to receive payments under notes, contracts for deed or otherwise arising (hereinafter collectively called "Notes and Liens")
Sec. 64.053. ENFORCEMENT OF SECURITY INTEREST IN RENTS GENERALLY.
(a) An assignee may enforce an assignment of rents using one or more of the methods provided by Section 64.054 or 64.055 or any other method sufficient to enforce an assignment of rents under a law of this state other than this chapter.
(b) On and after the date on which an assignee begins to enforce an assignment of rents, the assignee is entitled to collect all rents that:
(1) have accrued but remain unpaid on that date; and
(2) accrue on or after that date.

Worked well for me to create a deed for a house I inherited. It was very thorough and easy to use. I have no experience with the law so I just googled terms I didn't understand and was fine. I also called land records a lot and ended up not needing a lot of the material included, but it was still good to have it.

Was warned by attorney that forms from internet have lots of mistakes. But after looking all over, took a chance on here. So far, I am satisfied, and actually happy that I got something that (I believe) meets my state and local requirements. Haven't filed the deed yet, or had to put it into effect, but being able to pick the local area, and have the relevant state law listed on the deed, gives me confidence. Also, got the whole package of possibly relevant forms, and a very good guide how to prep the deed with a sample completed deed - greatly appreciated!

You charge too much for a form. Your business model is shortsighted. I would not try to use your service again. You got $20 from me this once, but I would try very hard to not use your service again. Your model does not encourage serial or professional usage.

The Lady Bird Deed appears to be fine with me as are the instructions. However, there apparently are no specific laws in Texas addressing them other than they are OK. The problem is that lenders are surely going to use them as triggers for their due on sale clauses, especially as the current small mortgage rates begin to increase. The solution to that seems to be to sign and have them notarized, but not to record them unless the holder needs to enforce the provisions. It seems to me that you should consider your solution to that problem in your instructions.
