Questions answered? Let's get started!
A Texas gift deed with a special warranty transfers real property to a family member or other recipient now, for no money, the giver standing behind the title for one carefully limited period: the giver's own years of ownership, and no further. This form prepares that deed under the conveyancing statutes of Property Code Chapter 5, pairing the gift recitals Texas case law expects with the traditional special warranty covenant.
The Middle Ground of Texas Warranties
Texas deeds run a spectrum. A general warranty deed guarantees the entire chain of title back to the sovereign; a deed without warranty carries no covenant at all. The special warranty sits between them: the grantor binds the grantor and the grantor's heirs and successors to warrant and forever defend the property against claims arising by, through, or under the grantor, but not otherwise. A defect the grantor created is the grantor's to answer for; a defect from an earlier owner is not.
The form pairs that express covenant with the statute behind the scenes. Property Code Section 5.023 implies title covenants into any deed that uses the words grant or convey unless the deed expressly provides otherwise, so this form expressly limits the implied covenants to the same by, through, or under scope. No covenant in the deed, express or implied, exceeds the special warranty.
A Completed Gift, Documented as One
No Texas statute names the gift deed; it rests on Property Code Section 5.021 and the case law of gifts, which requires donative intent, delivery, and acceptance, all three recited in operative terms with consideration of love and affection. And because property a spouse acquires by gift is separate property under Family Code Section 3.001 and Article XVI, Section 15 of the Texas Constitution, the form recites the gift characterization expressly, supporting a married grantee's separate property claim on the face of the recorded deed.
Married Grantors and Homestead
A gift deed is a lifetime conveyance, so the homestead joinder rule of Family Code Section 5.001 applies: where a married grantor conveys homestead property, the grantor's spouse joins by signing. The form carries a labeled second signature block for a second grantor or joining spouse, each signer with a separate notary certificate.
What Is Included
- The blank special warranty gift deed as a fillable PDF, completed on screen or printed and completed by hand
- A plain language guide covering every numbered section, the warranty's scope, and recording, creditor, and federal gift tax considerations in general terms
- A completed example showing the entire deed filled in for a realistic Tarrant County family gift
The document is formatted for Texas recording standards: letter size pages within Local Government Code Section 191.007, the Section 11.008 notice of confidentiality rights in 12 point capitals on page one, grantee address blanks serving Section 11.003, and reserved space for the clerk's recording stamp. A non-recorded instructions page is removed before signing.

I could not be happier with the service afforded by Deeds.com. After having been directed to two other organizations who purportedly performed this service and being told they could not accommodate me, I found Deeds.com. The website is extremely easy to use, the directions are clear and concise. The site updated me regularly as the documents were progressing through the process, and the detailing of costs was great. The turn-around -- which isn't completely in the hands of the site -- was incredibly quick. I'd use this group again without reservation. As a person who'd have to otherwise travel almost five hours to record, this has been heaven-sent!
We appreciate your business and value your feedback. Thank you. Have a wonderful day!

The site is easy to navigate and exceptional services. Unfortunately, they could find no information on a tract of land that I own, and they canceled the search and refunded my payment.
Sorry we were unable to help you find what you were looking for Joseph.

Was warned by attorney that forms from internet have lots of mistakes. But after looking all over, took a chance on here. So far, I am satisfied, and actually happy that I got something that (I believe) meets my state and local requirements. Haven't filed the deed yet, or had to put it into effect, but being able to pick the local area, and have the relevant state law listed on the deed, gives me confidence. Also, got the whole package of possibly relevant forms, and a very good guide how to prep the deed with a sample completed deed - greatly appreciated!
We appreciate your business and value your feedback. Thank you. Have a wonderful day!

Well, When I got the question right I got the answers right from Claim Deed. In the end it all worked out very, very good. I'm pleased with the deed and the price was very fair. Thank you for answering all my crazy questions. Now all we have to do is go to UPS and sign it. Thank, again.
Thank you!

I was extremely pleased with this experience, which literally took a minimum amount of time. One recommendation: make certain that when documents are uploaded that they have been received in the appropriate file. The lack of clarity caused me to upload twice or three times. Thank you.
Thank you for your feedback. We really appreciate it. Have a great day!

Very easy to fill out and and saved a lot of extra cost by doing it ourselves and getting it notarized.

I like that DEEDS.com has a variety of forms tht I may need. However, I was disappointed that I am not able to save the PDF forms after I fill in the spaces. If I need to edit anything, I have to go back to the blank form and redo the whole thing. Perhap I am doing something wrong.
Thank you!

Unfortunately for me this website was of no help, due to the amount of paperwork that needed to be submitted. One thing I can say they responded with answer really quickly. If this is a website that only deals with quick and fast deed issues, then it should indicate what they can and cannot do.
Thank you for your feedback. We really appreciate it. Have a great day!

It would be nice if the notary State was fillable, we are having to notarize in another State. Also, need more room to add 2 beneficiaries with two different addresses.
Thank you for your feedback. We really appreciate it. Have a great day!
