When is this document used?
When a property is sold, and a Contract has been executed by both parties this Memorandum document is often recorded in the county where the subject property is located instead of the actual Contract. Stating - Seller has agreed to sell, and Buyer has agreed to buy, the Property upon the terms and conditions set forth in the Contract.
Why a Memorandum of Contract?
Privacy - When parties want to keep financial details of a Contract for Deed, Land Contract or Buy-Sell Agreement private, a Memorandum is recorded.
Notice - puts the world on notice that a Contract between buyer and seller exists on a specific property.
Legal - legal binding agreement between buyer and seller concerning the property in question.
Protection - Often filed by buyers alone, after a contract has been executed, preventing loans or encumbrances being placed on the property by existing Deed holder. Encumbrances have been placed on properties even though the Contract states they can't. This can be devastating for a buyer who has made payments. A Memorandum is an effective instrument to prevent this. In short, either the Contract or Memorandum should be recorded for your protection.
Seller Financing - When the buyer chooses or is obligated to obtain bank financing a Memorandum legitimizes the purchase agreement, providing proof to the bank that a deal was in place. Most banks will require that the Contract or Memorandum be recorded before they will finance the property in question.

Highly Pleased- Strongly Recommend Deeds.com Long review... sorry:-) Originally I was very skeptical due to the enormous amount of the scams going on now days and the number of online sources that "claim" to provide you with deed forms for free or for a few. Nothing that you need and want done is free. There is always a cost. So luckily I came across deeds.com. This was the only site that appeared to be simple, to the point, and made no crazy promises. So before selecting this site, I did a little more checking around/price checking to ensure I am getting the best price for the product I needed. I even checked Staples and Amazon to find that they do indeed sell these forms but I do not think the products they provide are specific for my state and county. They claim their forms provided are for all states but my state is specific and I prefer to have forms provided by Deeds.com that is based on Indiana statute that Deed.com clearly identifies on each form. Deeds.com price of $20 seemed a little high at first but when I saw the products provided, the $20 cost is more than reasonable and fair. You not only get the deed form specific for my state and my specific "county" but also the other various/supplemental forms that may be required. Being familiar with my state and knowing how tedious and anal my state is on everything, I was pleasantly please to see the info and extra supplemental forms provided. For example, a person new to the State who recently had property deeded to them, would not necessarily know about the Homestead tax exemption provided if property is your primary residents, over 65 exemption etc. I would highly recommend this site for anyone needing these documents because Deeds.com has you covered on any and all forms/info you could ever need! A bonus is that there is one flat fee and not monthly cost that you have to worry about canceling later unless you superficially select a monthly package. I love the fact that Deeds.com is nothing fancy. There is not a bunch of elaborate graphics etc. They only provide what you need and what they provide is very accurate. Deeds.com has a customer for life.

Form needs to be gender neutral. Also, while the format prompts for the correct information to be included, more of the form needs to be open for editing and to eliminate unnecessary spacing.

This was a seamless process. It probably took one minute to fill out my information and upload the document. It was formatted and sent immediately. It was processed the next day at the county recorders office. I have zero complaints. Before finding this company I spent an entire day calling and leaving messages at other e-filing companies like simplfile and others but they all required subscriptions. I just needed to file a single document now and then so that was not a good fit. (And those companies I found out still require the customer to do all the work!). It was convenient to be able to download the deed template, instructions, and a completed sample deed all from deeds.com. I was able to complete my deed with little effort. My only complaint is that the editable fields in the pdf document are of fixed size, leaving some large spaces within a sentence, for example: Executed on this 1st day of July ,2020. This makes the printed document look a little peculiar.
