The Request for Information from Original Contractor is a form letter used to obtain information from the contractor regarding the identity of persons furnished with labor or materials, whether a payment bond has been posted, and project dates.

Under TEX. PROP. CODE 53.159(b), upon a written request, an original contractor who furnished work under the original contract shall furnish to the person the following information within a reasonable time, but not later than the 10th day after the date the request is received:
(1) The name and last known address of the person to whom the original contractor furnished labor or materials for the construction project;
(2) Whether the original contractor has furnished or has been furnished a payment bond for any of the work on the construction project and if so, the name and last known address of the surety and a copy of the bond; and
(3) The date on which the original contract for the project was executed.

Serve the form to the original contractor through certified U.S. Mail with return receipt requested. It does not need to be verified or notarized. Note that if the requester is not in direct contractual relationship with the contractor on the project, that person may require payment of the actual costs in producing the information which cannot exceed $25.00. TEX. PROP. CODE 53.159(e). Therefore, some individuals choose to enclose a check with the request form, up to $25.00.

If the original contractor fails to furnish the required information, he or she may be liable for reasonable and necessary costs incurred in procuring the requested information. TEX. PROP. CODE 53.159(f).

Order Process: 5 Stars - very easy Material Received: 2 Stars Issues: 1. Printing- Document would not print in format displayed. Format would continually shrink to approx 2/3 size thus not useable for formal doc submission to County Records office. 2. Document Format- Data insertion fields (addresses) were not of correct size for data input. I needed a 4 line input space but was limited to only 3 lines. Also, Date field (year) was mis-oriented in-so-much that the 3rd digit (inputted) overlapped on 2nd digit (pre-printed) and also was of noticeably different font. 3. Useability- Hand-written input space provided (for Notary) was deficient in space and spacing. It was a challenge to utilize the space available to complete fully and maintain legibility. Overall - the document worked marginally as advertised, I did need to re-write the entire document myself. It is a good concept but I'd recommend that Deeds company improve the downloaded forms for actual useability, readability, functionability. regards, Jim S

The forms were immediately available for download, which was nice. However, I was not impressed by the lack of several features: 1) there was no way to edit set text in the form, such as where it says you should consult an attorney. That is not necessary for recording the deed and I wanted to deleted it, but could not. 2) Also, under the "Notes" section, there is a limited area to write; I tried adding a fuller explanation of something, but the form would not accept or include it when I printed the final document. The form may do the job, but it's not very sophisticated or elegant.

I liked the service very much. The form I ordered wasn't provided by the local government agency and I couldn't find it on the internet.
