A Texas transfer on death deed lets a property owner name who receives their real estate when they die, without probate, without giving up anything during life. This form prepares a transfer on death deed for one owner under Chapter 114 of the Texas Estates Code, the Texas Real Property Transfer on Death Act.

How a Texas Transfer on Death Deed Works

The deed is nontestamentary. It transfers no interest while the owner is alive, so the owner keeps full control: the property can still be sold, mortgaged, or leased, homestead status and property tax exemptions are unaffected, and the deed can be revoked at any time. At the owner's death, the beneficiary named in the deed receives whatever interest the owner holds at that moment, subject to any mortgage or other matters then affecting title.

Texas wrote several of its own rules into Chapter 114. The capacity required is the capacity to make a contract, not a will, and the deed cannot be created through a power of attorney. A will does not revoke or override a recorded transfer on death deed. Most importantly, the deed must be recorded before the owner's death in the county where the property is located; an unrecorded deed transfers nothing, no matter how carefully it was signed and notarized.

Who This Form Describes

This form recites a single transferor: one record owner of Texas real property, married or unmarried, signing alone. A spouse who is not a record owner is not a transferor and has no signature line, and the guide explains why the spousal joinder rule for homestead conveyances does not reach a deed that conveys nothing during life.

Married couples who hold plain community property, the default for property acquired during a Texas marriage, often use a pair of these deeds: each spouse signs one naming the other spouse as primary beneficiary and the same alternates, so the survivor receives the property at the first death and the alternates receive it at the second. Where title carries a right of survivorship, the joint owner and community property versions of this deed recite that vesting instead.

Beneficiaries and Survival

The form provides for primary beneficiaries, optional alternates, and optional special provisions such as unequal shares. Under Section 114.103, a beneficiary must survive the owner by 120 hours, and where no special provision says otherwise, multiple beneficiaries take equal undivided shares.

A 2025 enactment, Senate Bill 16 of the Second Called Session of the 89th Legislature, also directs the county clerk to require photo identification from a person who presents a document in person for filing in the real property records, a step that takes place at the counter and does not change the content of the deed. A separate instructions page included with the form, removed before recording, describes how an entry that outgrows its space continues on a recorded exhibit page, so the recorded deed stays free of worksheet style captions.

Highly Pleased- Strongly Recommend Deeds.com Long review... sorry:-) Originally I was very skeptical due to the enormous amount of the scams going on now days and the number of online sources that "claim" to provide you with deed forms for free or for a few. Nothing that you need and want done is free. There is always a cost. So luckily I came across deeds.com. This was the only site that appeared to be simple, to the point, and made no crazy promises. So before selecting this site, I did a little more checking around/price checking to ensure I am getting the best price for the product I needed. I even checked Staples and Amazon to find that they do indeed sell these forms but I do not think the products they provide are specific for my state and county. They claim their forms provided are for all states but my state is specific and I prefer to have forms provided by Deeds.com that is based on Indiana statute that Deed.com clearly identifies on each form. Deeds.com price of $20 seemed a little high at first but when I saw the products provided, the $20 cost is more than reasonable and fair. You not only get the deed form specific for my state and my specific "county" but also the other various/supplemental forms that may be required. Being familiar with my state and knowing how tedious and anal my state is on everything, I was pleasantly please to see the info and extra supplemental forms provided. For example, a person new to the State who recently had property deeded to them, would not necessarily know about the Homestead tax exemption provided if property is your primary residents, over 65 exemption etc. I would highly recommend this site for anyone needing these documents because Deeds.com has you covered on any and all forms/info you could ever need! A bonus is that there is one flat fee and not monthly cost that you have to worry about canceling later unless you superficially select a monthly package. I love the fact that Deeds.com is nothing fancy. There is not a bunch of elaborate graphics etc. They only provide what you need and what they provide is very accurate. Deeds.com has a customer for life.

I purchased the Notice of Completion form because the City of Chula Vista did not have a "fillable" version of this form on their website. The Deeds.com version of this form is somewhat different than the City's version (8 numbered paragraphs vs. 11 numbered paragraphs.) However, it contains the same information in a different format. This form provided more blank space to fill in important items- like a long ownership name- than the version on the City's website. The recorder's office was satisfied with this form as I hand-delivered it to the Recorder's Office and they approved it for recording. Overall, I found this form easy to use and found the extra blank space for writing on the form helpful. My one comment for possible improvement is: it would be even more helpful (particularly for attorney users) to have strike-out capability. I would have liked having the ability to strike-out inapplicable portions of long awkward sentences. Still, I would use this form again.
