An easement gives a person the right to use another's real property for a specific purpose. This is a non-possessory interest and can relate to solar rights, utility easements, and other types of appurtenant or easements in gross. In Virginia, unless the terms of an easement deed provide otherwise, the owner of a dominant estate cannot use an easement in a way that is inconsistent with the uses allowed by the grant of the easement. Further, the owner of the servient estate cannot engage in an activity or cause any objects to be present upon or adjacent to the burdened land which would unreasonably interfere with the enjoyment of the easement by the owner of the dominant estate ( 55-50.1). The owner of land that is subject to an easement for the purpose of ingress and egress may relocate the easement, on the servient estate, by recording a written agreement evidencing the consent of all affected persons and setting forth the location of the easement. This agreement is to be recorded in the office of the clerk of the circuit court in the county or city where the easement is located ( 55-50). An easement deed should be in writing and should contain the terms of the agreement, the duration and scope of the easement, and a description.

Before it can be admitted to record, an easement deed must contain the grantor's original signature, which must be acknowledged by him or proved by two witnesses. A certificate of acknowledgment evidencing such acknowledgment should be attached to the deed ( 55-113). Notarial acts can be performed within this state or out of state. Out-of-state acknowledgments will have the same effect as acknowledgments performed by a notary public in Virginia and such acts may be performed by any officer who is authorized to perform notarial acts in the place where the act is performed ( 55-118.1). Acknowledgments taken in another state must conform to the rules contained in 55-118.2 of the Virginia Code. The official seal of the person performing the notarial act, whether or not it is in this state, should be affixed to the document ( 55-118.2).

An easement deed in Virginia must be recorded in the city or county where the property subject to the easement is located in order to provide constructive notice of the instrument. Until the deed is recorded, it will be void to all purchasers for a valuable consideration without notice who are not parties to the deed and will also be void as to lien creditors ( 55-96). This is a race-notice recording act, which means that a later buyer who pays fair value and records a deed first without having notice of any earlier conflicting interests will have priority over later recordings.

Glad to have all of the helpful extra information, even though they don't answer all questions for all situations. So, I accessed public records and asked questions at the auditor's office. Also, on my Mac computer, filling out the actual deed form is a challenge because the screen jumps to the last page everytime I try to type a few letters or hit the return key, so I'm rollling back up to the first 2 pages after most keystrokes. A bit annoying. Overall, happy to have these form options are available! There is really no need to wait and pay for an attorney when all the information needed is available via public records. Fill in the blanks!

I purchased the Notice of Completion form because the City of Chula Vista did not have a "fillable" version of this form on their website. The Deeds.com version of this form is somewhat different than the City's version (8 numbered paragraphs vs. 11 numbered paragraphs.) However, it contains the same information in a different format. This form provided more blank space to fill in important items- like a long ownership name- than the version on the City's website. The recorder's office was satisfied with this form as I hand-delivered it to the Recorder's Office and they approved it for recording. Overall, I found this form easy to use and found the extra blank space for writing on the form helpful. My one comment for possible improvement is: it would be even more helpful (particularly for attorney users) to have strike-out capability. I would have liked having the ability to strike-out inapplicable portions of long awkward sentences. Still, I would use this form again.

I purchased this form to add my boyfriend to the deed of our home. He owns his own business so he cannot be on our mortgage. The guide doesn't clearly explain adding a person rather than focusing on transferring during a purchase or selling of a home. For future, I'd recommend make a few different examples for those who are trying to use this for the other options a Quit Claim Deed is needed for.

You form was good the only thing that did not work was the download to fill it out !!! I use a Mac system and maybe that's what the issue was. I filled it out by hand and it worked for the purpose .

I am a litigator based in Lee County that rarely needs to record deeds or mortgages. However, at times, the settlement or resolution of a dispute results in the conveyance of real property. I ended up in a situation where a deed to real property in Bradford County needed to be recorded on behalf of a client. My usual e-recording vendor does not include that County. Registering with Bradford County's regular e-recording vendor would have required an expensive and unnecessary annual fee. Deeds.com was easy to use, inexpensive and fast. I highly encourage its use, especially for lawyers that occasionally need to record instruments but do not do so regularly.
