The certification of trust is part of the Uniform Trust Code, codified in West Virginia at 44D-10-1013, and provides protection for parties doing business with trustees. The document "need not contain the dispositive terms of a trust" ( 44D-10-1013(d)) and, in West Virginia, is generally not recorded with land records. Rather, the certification is presented to third parties such as banks or other financial institutions doing business with a trustee.
Executed by any trustee, the certificate contains only the pertinent information required for the business at hand and is a basic summary of the trust instrument. It states that the trust exists and that it has not been revoked or modified in a way that would invalidate the information presented within. In addition, it requires the name of each settlor and acting trustee; the trustee's relevant powers; the name of anyone having a power to revoke the trust; the trust's taxpayer identification number; and the name by which the trust vests title to property. The form also details the signing authority of co-trustees, if applicable.

I recieved my document in a reasonable amount of time. I thought being a member i would be able to look up more than 1 document but it keeps asking me for more money. Delivery of documents was instantaneous once payment is received. Thank you for that. For future clarification to potential users, Deeds.com may want to categorize the type of easement documents that are available. I was needing a 'utility easement' form and received an 'ingress/egress' form. Had I known it was an ingress/egress document, I would not have made the purchase. Outside of this issue, this site is very helpful for the average layperson to hold guardianship over personal interests.

I thought the forms were reasonably priced, the instructions included in the packet were thorough, and the examples helpful. Thank you for the additional CDR forms too. I contacted the Recorder's office via email with a question and Jennifer Bowser answered promptly. Job well done! However, when I delivered the deed and Real Property Transfer Declaration to the Clerk's office in Lafayette, the clerk was unfamiliar with the Declaration document being submitted and it took some time to convince her to submit the form without charging the recording fee. She even tried to phone the recorder's office for clarification, but no one answered. There then was an additional form at that office that I had to complete called Recording Request/Transmittal Form. I would suggest including that form with instructions in your on-line packet to speed up the process when a Deed is delivered to the County Clerk's satellite office. I do not expect every clerk to know all the particulars of recording requirements but a little knowledge wouldn't hurt.

In Colorado a Release of a Deed of Trust without the original note must be efiled - the Recorder said it had to be Simplifile or CSC Global neither of whom are designed to do a 1 off filing (you have to subscribe). Fortunately, I found Deeds.com - they were great. helped me work through a couple clerical issues and it is done. I am so happy and pleased. I would give them more stars if I could. I will spread the word among the realtors and title companies who couldn't help that there is a better option.
