Questions answered? Let's get started!
Seller Financing
This is the #1 use.
A land contract lets the seller act like the bank:
• Buyer makes payments directly to seller
• Seller keeps legal title until paid in full
• Buyer gets equitable title and possession
Useful when:
• Buyer can’t qualify for traditional financing
• Seller wants interest income
• Faster closing, fewer lender hoops
Credit-Challenged or Self-Employed Buyers
Banks often won’t lend to:
• Buyers with recent credit issues
• Self-employed buyers with complex income
• Buyers with short job history
A land contract:
• Avoids lender underwriting
• Lets buyer refinance later once credit improves
• Often used as a temporary bridge to bank financing
Estate, Family, or Private Transactions
Common in:
• Family sales (parents → children)
• Estate planning
• Intra-family wealth transfers
• Closely held business or farm property transfers
Why?
• Flexible terms
• Lower transaction costs
• Control over timing of final deed transfer
Investment Property Sales
Used frequently by:
• Real estate investors
• Landlords exiting rental property
• Sellers wanting steady cash flow
Advantages:
• Monthly income with interest
• Retain title as security
• Often easier to enforce than unsecured debt
Must be careful with:
• Proper default remedies
• Wisconsin forfeiture statutes (not eviction-by-affidavit)
Rural, Farm, or Unique Properties
Banks sometimes hesitate on:
• Rural land
• Mixed-use property
• Small farms
• Nonconforming improvements
Land contracts:
• Bypass lender restrictions
• Allow custom terms
• Are historically common in rural Wisconsin
Tax Planning / Timing Considerations
Sometimes used to:
• Spread income recognition over time
• Defer capital gains (installment sale treatment)
• Match income with retirement planning
This is tax-sensitive and usually coordinated with a CPA.
Title Control & Risk Management for Seller
Because the seller retains legal title:
• Seller has stronger leverage than with a mortgage
• No need to immediately release title
• Buyer’s interest can be forfeited through court process if defaulted
In Wisconsin:
• Forfeiture is judicial
• Seller cannot simply evict or record an affidavit
• Homestead protections apply
Wisconsin-Specific Legal Reality (Important)
In Wisconsin:
• Land contracts are heavily regulated
• Forfeiture must comply with Wis. Stat. §§ 846.30–846.35
• Homestead rights cannot be waived
• Seller must go through court to terminate buyer’s rights
• Eviction only happens after judgment + redemption period
This makes land contracts powerful — but not casual.

Exactly what I needed and VERY fair price. I paid $19.97 for what a local attorney wanted $200 to do. I filled out the form using the line by line guide and filed it at the court house today. Absolutely no problems.
We appreciate your business and value your feedback. Thank you. Have a wonderful day!

They respond fast, the process is simple, and it's obviously convenient. I'm not sure what else there is to say, other than it's I would say a reasonable fee to pay them to do it.
Thank you for your positive words! We’re thrilled to hear about your experience.

Documents are great and easy to use, just wish there was a page helping to know where to mail documents to with an amount since it tells you mailing in is an option.

Laborious process to gain access; need to indicate PRIINT when complete and inform that if page is backspaced, entered info disappears, necessitating starting all over again. There is only one “A” provision, when some documents have several more. Space is too limited in some instances to provide what is necessary for recording. Thank you
Your feedback is valuable to us and helps us improve. Thank you for sharing your thoughts!
