The Clerk and Recorder is responsible for recording and maintaining real property records in Carbon County.

Recording Fees

To record a standard document, the fee is $8 per page.

For non-standard documents, add a $10 document fee.

Unless accompanied by the fee imposed on non-standard documents, all documents submitted for recording must meet the requirements.

Document Formatting Requirements

* A standard document is legibly printed or typed in blue or black ink on white paper that is either 8.5 x 11 inches or 8.5 x 14 inches. Addresses of grantees must also be in blue or black ink when legibly printed in. A whole document legibly printed in blue or black ink and meeting all other requirements is recorded as standard. A whole document written in cursive is non-standard. A document that includes highlighting is also non-standard.

* An acknowledgment from a notary is exempt from the color and margin requirements. The notary seal must be legible.

* Margin requirements are: 3 inches at the top of the first page and at least 1 inch at the top of all subsequent pages. The bottom margin on all pages should be at least 1 inch. Side margins on each page should be at least 1/2 an inch.

* If an insignificant portion of a signature (such as the tail-end of the last letter) extends into a margin, the document will still be standard. However, if a significant portion of a signature (a designation such as Jr., Sr., III, etc.) extends into a margin, this will cause the document to be non-standard.

* Provide the names of the parties to the conveyance on the first or second page of any document with more than page.

* Include the name and mailing address of the person to whom the deed is to be returned after recording. This should be placed in the margin in the upper left-hand corner of the first page and can be legibly printed in ink or typed. If no return address is included in the upper left-hand corner of the first page, the deed will be non-standard. Documents will be returned to the address listed in the appropriate section---no exceptions. If the submitter wants the document sent to another address, they must write the correct address in the appropriate place on the document before it is recorded.

* Except for page numbers or other administrative information or designations, margins must be clear of all markings. A list of designations approved by the document standards committee is available on the Carbon County Clerk and Recorder's website.

* If conveying an interest in real property, a legal description of the real property must be provided. Documents that convey an interest real property might include deeds, contracts for deed, reconveyances, deeds of trust, easements, or any document requiring a Realty Transfer Certificate. This is not a complete list. A street address is not sufficient as a legal description, nor is a deed reference. The full metes and bounds description or subdivision with lot or certificate of survey number must be included. A substitution of trustee does not need a legal description, just a reference to a previously recorded document.

REALTY TRANSFER CERTIFICATE

A completed Realty Transfer Certificate must be presented to the Clerk and Recorder any time a deed is presented for recordation, regardless of whether the transfer is or is not evidenced by a deed or instrument. The Department of Revenue will change the ownership records when this form is fully and accurately completed and signed. Real estate includes land, growing timber, buildings, structures, fixtures, fences, and improvements affixed to land. The Realty Transfer Certificate assists the state of Montana in providing fair and equitable taxation to all its citizens, as well as improving compliance by non-residents and out-of-state companies.

For tax purposes, it is important that all information requested on the Realty Transfer Certificate is accurately furnished by the preparer in order for ownership to be changed on the real property. This information includes the disclosure of the last four digits of a Social Security Number or a Federal Employment Identification Number of individuals or entities involved in the transfer. If the transfer of real property involves foreign nationals, an Individual Taxpayer Identification number needs to be provided.

Any gain on a transfer is Montana source income and should be reported to the Department of Revenue on the appropriate income tax return.

All Realty Transfer Certificates must be signed and dated by the preparer. By signing, the preparer indicates that the information provided is true and correct to the best of his/her knowledge, and that the grantor and the grantee have examined the completed Realty Transfer Certificate and agree that the information contained within it is correct and accurate.
