The County Clerk is responsible for recording and maintaining real property records.

Recording Fees

To record a document in the deed or mortgage record, the fee is $105 for the first page and $5 for each additional page.

Lien records: $76 for the first page, $5 for each additional page.

A non-standard document is an additional $20 per document.

Documents describing more than one transaction will be $5 per additional transaction or title.

Copy fees are $2.50 per page.

Document Formatting Requirements

* The original document presented for recording must be legible and must be required or permitted by law to be recorded. Signatures and notaries must be originals.

* A blurred or faint Oregon notary seal is not acceptable for recording. Corrections can be made by writing the information outside the perimeter of the seal by the notary. A new seal can also be affixed. Notary seals must not cover any printed material on the certificate or instrument.

* Any document that contains text not sufficiently legible to reproduce a readable photographic record will be returned without being recorded. For example, faxes or copied documents, even with original signatures, often do not meet the legibility requirements.

* Flaps or riders must be attached to the page at the top and bottom. Anything under the flap will not be recorded. Do not use staples or paperclips for attachments.

* Use white paper that is letter or legal sized (8.5 x 11 inches or 8.5 x 14 inches). Pages that are smaller than 8.5 x 11 inches should be attached at the top and bottom to an 8.5 x 11 inch piece of paper. Do not use staples for this attachment.

* The font should be in black type or ink, and should not be smaller than 8 point.

* The weight of the paper should be sufficient to prevent bleed through from the front to back. Paper that is at least 20# bond will be of sufficient weight.

* All recording tickets will be placed at the top or bottom of the first page. A document must provide sufficient space for the ticket, which is approximately 3 inches wide and 2 inches high. In general, it is best to err on the side of caution.

* If sufficient space is not provided at the top or bottom of the first page for the recording ticket, a cover sheet will need to be added with the required space. Using a cover sheet will add $5 to the recording costs. A cover sheet can be downloaded from the Wasco County Recorder's webpage.

* A statement given in full in ORS 93.040 needs to be included in the body of an instrument transferring or contracting to transfer fee title to real property, except for owner's sale agreements or earnest money receipts.

* Documents pertaining to real property must contain a legal description of the property. The property can be described by giving the subdivision according to the United States survey when coincident with the boundaries thereof, or by lots, blocks and addition names, or by partition plat recording and parcel numbers, or by giving the boundaries thereof by metes and bounds, or by reference to the book and page, document number and fee number of any public record of the county where the description may be found. However, description by tax lot number shall not be adequate for the legal property description. Initial letters, abbreviations, figures, fractions and exponents, to designate the township, range, section or part of a section, or the number of any lot or block or part thereof, or any distance, course, bearing or direction, may be employed in any such description of real property.

The following must be clearly labeled and shown on the first page:
a. The title of the document.
b. The names of all parties to the agreement,
c. The person and address to whom the document is to be returned (labeled as "Return to").
d. The true and actual consideration.
e. The name and address to where future tax statements are to be sent (labeled as "Mail tax statement to").
f. Information required for County Clerk lien records (if applicable).

Warranty deeds may be in the following form:
