This form is used for the sale of real property located in Alabama. The principal designates an agent and empowers him/her to act in all necessary legal documents for the sale of a specific property. The Limited Power of Attorney is durable and shall not be affected by the principal's disability, incompetency, or incapacity and terminates immediately upon the satisfactory closing of the specified property.

This was the first time I had ever had to fill out a Warranty Deed, so if it was not for your example form on how to fill one out, I would be still be here completely lost. The Lady Bird Deed appears to be fine with me as are the instructions. However, there apparently are no specific laws in Texas addressing them other than they are OK. The problem is that lenders are surely going to use them as triggers for their due on sale clauses, especially as the current small mortgage rates begin to increase. The solution to that seems to be to sign and have them notarized, but not to record them unless the holder needs to enforce the provisions. It seems to me that you should consider your solution to that problem in your instructions.
