Special warranty deeds transfer title to real estate from the grantor (owner) to the grantee (buyer), with a guarantee that the grantor will defend the grantee against any outside claims to the title that originate from the time she owned the property, and that all restrictions, limitations, and/or obligations associated with the property are disclosed on the deed. They offer a compromise between a full warranty deed, which requires the grantor to defend the title against ANY claims from before the grantee took ownership, and a quitclaim deed, which offers no protections whatsoever.

Valid special warranty deeds identify the parties by full name, marital status, and address, the property's legal description, physical address, the signatures of all grantors and spouses, and a notary acknowledgment. They must also meet all state requirements as set out in Section 35-4 of the Code of Alabama, and any local standards for form and content.

Alabama law demands that all deeds must be recorded (35-4-50). This provides notice of the change in ownership to the public. Record the signed and notarized deed at the office of the probate judge for the county where the property is located.

Glad to have all of the helpful extra information, even though they don't answer all questions for all situations. So, I accessed public records and asked questions at the auditor's office. Also, on my Mac computer, filling out the actual deed form is a challenge because the screen jumps to the last page everytime I try to type a few letters or hit the return key, so I'm rollling back up to the first 2 pages after most keystrokes. A bit annoying. Overall, happy to have these form options are available! There is really no need to wait and pay for an attorney when all the information needed is available via public records. Fill in the blanks!

What a wonderful and easy task using deeds.com. I searched on line for the proper procedure to file a quit claim deed. It looked to confusing to do mysellf until I found deeds.com. With their instructions, I was able to fill out all the proper forms and file with the court in two days. Saved me at least a thousand dollars if I had an attorney do the same. Thank you. Pros, quick purchase and document availability including instructions and examples. Cons, For the cert. of trust, the form would not accept the length of our trust name with no way to get around. The pdf file printing did not meet the requirements for 2.5" top margin and .5" other margins as well as the 10pt font size as the form information was shrunk down even when normal printing.
