Filing a Mechanic's Lien in Alabama

Obtaining a lien for construction work, including the furnishing of labor or materials, must be accomplished by filing a verified statement with the probate court in the Alabama county where the subject property is located.

Every person entitled to a lien must file, in the office of the judge of probate of the county in which the property upon which the lien is sought is situated, a statement in writing, verified by the oath of the person claiming the lien, or of some other person having knowledge of the facts, containing 1) the amount of the demand secured by the lien, after all just credits have been given, 2) a description of the property on which the lien is claimed in such a manner that same may be located or identified, a description by house number, name of street, and name of city or town being a sufficient description where the property is located in a city or town, and 3) the name of the owner or proprietor thereof; but no error in the amount of the demand or in the name of the owner or proprietor, shall affect the lien. Ala. Code Ann. 35-11-213. Unless such statement is so filed the lien shall be lost. Id.

To preserve lien rights under Ala. Code Ann. 35-11-215, claimants must file the verified statement according to the following time limits:
by every original contractor within six (6) months;
by every journeyman and day laborer within 30 days; and
by every other person entitled to such lien within four (4) months
after the last item of work has been performed or the last item of material has been furnished. Keep in mind that once the lien is in place, is still must be enforced through a lawsuit if the owner still refuses or is unwilling to make full payment.

Very disappointed that you had certain documents but did not have the accompanying documents needed to complete the transfer. I also had issues with the documents not allowing you to fill in the pages... example the document was prefilled in as so ... Page 1 of_____ but you could not fill in the blank... I tried reaching out to your customer service, but they had no solution for me. So, I had to write in the page, which didn't look professional. I think I could have gotten documents just as good for free if I'd research a little longer.

The Virginia Transfer on Death Deed and the Virginia Transfer on Death Beneficiary Affidavit are separate documents and are offered individually because many customers only need one, depending on their situation. In your case, the affidavit was later ordered separately.

Regarding the page numbering (“Page 1 of ___”), that field is intentionally left blank. The total number of pages is not known until the document is finalized, signed, notarized, and all attachments (such as exhibits or legal descriptions) are included. It is standard practice to complete that portion by hand at execution so the final page count accurately reflects the recorded document.

Thanks Mike. We get it, $27.97 isn't cheap for a lot of people right now. Your Nevada package includes a recorder-ready affidavit, a completed sample, and step-by-step instructions for the state. Expensive, yes. Overpriced, not even close.

The "Trustee's Deed" should have been labeled a Deed of Trust because that's what it really is. So now I just wasted $19.97 getting something I can't use.

We have been waiting for a Title Company to put a release of Lien together for the past 3 months. I figured it was taking way to long and decided to use template here instead. In less than hour I was able to add all the information on the template and provide forms to our Seller to use. We were buying and he didnt think they were necessary. But I refused to pay him in full until he agreed to sign papers at the bank, and of course in front of a notary. We turned around and filed the Release of lien paperwork at County Clerks office, we officially own our house. Thank you!
