What is the Arizona Beneficiary Deed?

This Arizona beneficiary deed meets or exceeds the statutory requirements as set forth in A.R.S. 33-405. When correctly executed and recorded, it allows owners of real property to retain absolute control over their real estate, with the freedom to use, modify, or sell the land at will. After the owner's death, the remaining interest in land transfers to the beneficiary outside of the probate process.

NOTE: In order to be valid, this deed must be recorded, during the owner's lifetime, in the county where the land is situated.

The instructions were not real clear in one section where there was reference to "prior deed" . I did not know whether I needed to locate the recording info for the prior deed or not and, if so, how it should be described. Maybe you can help. Is it necessary to complete that information if there was a regular deed to the grantor of this beneficiary deed and this is simply a conveyance to another grantee. If so, how does a person locate the recording information in terms of book and page etc? Other than that, and this may be kind of a big caveat, the product was fine. Please respond if you read this. Thanks. Richard Vander Mey

The forms worked out well and I had no trouble filing with the court. My only concern was that the box that opened in the document to fill in the necessary information did not accurately line up with the appropriate space once it was closed and saved. It still was ok with the court but slightly off.
