Lien waivers are part of the Arizona mechanic's lien process. The waiver, given by a contractor, subcontractor, materials supplier or other party to the construction project (the claimant) acknowledging receipt of payment and waiving any future lien rights to the owner's property. In Arizona, lien waivers require strict compliance with the statute and any document purported to waive a lien must follow the statutory format. AZ REV. STAT. 33-1008(A). There are two classifications of lien waivers: conditional and unconditional. Within either class, there are subcategories of "partial" and "final" waivers. Unconditional waivers take effect without payment confirmation, but conditional waivers are effective only when payment is received, usually verified by a check clearing the bank. So, a conditional waiver given after the final payment releases the claimant's right to lien, but only after any check used to pay the bill clears the bank.

The waiver must contain details identifying the job/project, the amount and type of payment, including the name of the person who wrote any checks, the property owner, the location and a description of the work, relevant dates, and the claimant's signature. 33-1008(D)(3).

The form is so limited in space that I can not fit the vesting information as well as the real property information. The property information, I could put it as Exhibit A. which is not the usual way. Not happy.

I am still in the trial stage. I am an older lawyer. Any help I can get is worth it. Once you get used to the format and data fill in the deed thing is excellent. Very professional if not a little slow. I have only done three deeds in one state so I will have to see how it goes. I like the product and their attitude towards pleasing the customer. We'll see when I try the recording part.

I liked having the forms. Some may need to know they can look at the legal Description from online county records, then type up in Word document line by line, the degree sign in Word program is achieved by using alt and 248 on number pad. Then on the form page one write SEE Exibit A and title your Word program description as Exibit A. Goes without saying the legal description should be looked over many times and it is easier to do so if you format your Word the same lineage as the legal description online which is usually not text which is why you have to retype it.

This product makes it so much easier to understand and file forms that you might have to pay an attorney to do. All Counties have their own way of submitting forms and with Deeds you have the correct format.

The Beneficiary Deed is easy to fill out, expecially with the examples/explanations provided. The only recommendation I would make is to state that the Parcel ID and the Assessor's ID are one in the same. I looked everywhere for something that mentions "Assessor's ID" in my paperwork to no avail. Upon calling the Maricopa Assessor's number in Maricopa I was told that they are the same.
