An easement, a non-possessory interest in someone's land, is created using the same formalities as a transfer of other interests in land. The property to which the easement pertains may be owned by a private person, a business entity, or a group of owners. Easements generally pass with the property.

One type of easement in Arizona, a conservation easement, is a non-possessory interest of a holder in real property imposing limitations or affirmative obligations for conservation purposes or to preserve the historical, architectural, archaeological, or cultural aspects of real property (33-271). Other types of easements include the right-of-way easement and the affirmative easement. An easement is created by conveyance in a deed with the easement type described in the first paragraph of the document.

As a conveyance of a real property interest, an easement in Arizona should be signed by the grantor, duly acknowledged, and then recorded according to law. The easement should be recorded in the county where the property which is the subject of the easement is located. The act of recording provides constructive notice of the contents to subsequent purchasers or encumbrance holders for a valuable consideration without notice.

This site was easy to use for access to State forms for filing in Montmorency County clerks office. Not only did I find claim form but a sample claim was available for assisting on how to complete your form correctly. Found this so very useful for us (public resident) to fill in the form as a .PDF file that prints out typed form - rather than handwritten entries. There is a fee but your access is always available on internet to this site in the future. Saved me time using this site and My filed form looks professional. You have access to several other forms if needed.

The forms were immediately available for download, which was nice. However, I was not impressed by the lack of several features: 1) there was no way to edit set text in the form, such as where it says you should consult an attorney. That is not necessary for recording the deed and I wanted to deleted it, but could not. 2) Also, under the "Notes" section, there is a limited area to write; I tried adding a fuller explanation of something, but the form would not accept or include it when I printed the final document. The form may do the job, but it's not very sophisticated or elegant.

Was warned by attorney that forms from internet have lots of mistakes. But after looking all over, took a chance on here. So far, I am satisfied, and actually happy that I got something that (I believe) meets my state and local requirements. Haven't filed the deed yet, or had to put it into effect, but being able to pick the local area, and have the relevant state law listed on the deed, gives me confidence. Also, got the whole package of possibly relevant forms, and a very good guide how to prep the deed with a sample completed deed - greatly appreciated!
