Under A.C.A. 28-73-1013, a trustee can furnish a certification of trust in lieu of the trust instrument to prove his or her authority to act on behalf of an established trust.
The certification is an official document a recipient can rely upon, and assume without inquiry the existence of the facts contained within (28-73-1013(f)(1)). The document contains only information about the trust deemed relevant to the immediate transaction for which it is requested. The recipient has the right to request excerpts from the trust document containing the information presented in the certificate, but this opens the recipient to certain liabilities (e),(h).
The certification includes basic information such as the name, date, and type (revocable or irrevocable) of the subject trust, and verifies that the trust has not been revoked, modified, or amended in any manner that would cause the representations contained in the certification of trust to be incorrect (c). It discloses the identities of the trust's settlor and all acting trustees, but maintains the confidentiality of anyone having a beneficial interest in the trust. The powers of the trustee relevant to the conveyance of trust property are enumerated, as well as any requirements for authenticating documents in the case that there are multiple trustees. Finally, the certificate establishes the name by which a trust will vest title to real property.
As with all documents relating to real estate, the certification should contain a legal description of the subject property. This is the same legal description found on the deed conveying the property into the trust. The certification of trust is signed by any trustee in front of a notary public before it is recorded in the county in which the subject property is situated.

We have been waiting for a Title Company to put a release of Lien together for the past 3 months. I figured it was taking way to long and decided to use template here instead. In less than hour I was able to add all the information on the template and provide forms to our Seller to use. We were buying and he didnt think they were necessary. But I refused to pay him in full until he agreed to sign papers at the bank, and of course in front of a notary. We turned around and filed the Release of lien paperwork at County Clerks office, we officially own our house. Thank you!

Overall positive experience; especially liked immediate access to downloaded documents and instructions. My only concern was lack of adequate space in portions of your beneficiary deed blank form which then required me to use 3 exhibits to complete all necessary documents for the county recorders office. Well, we are 10 days from leaving the country for months and needed to notarize and record deed changes to our rental properties. We worried about USPS, UPS, DHL, etc. and hardcopies in the County's bureaucrats' hands. Soooo, we learned of Deeds.com from the County web site via one of the bulk digital recorders telling me about Deeds.com. Hit their site, read their instructions, concluded my tiny brain and decrepit abilities could handle the chore. WITHIN AN HOUR OF UPLOADING EVERYTHING INCLUDING C.C. FOR PMT IT WAS RECORDED AND I printed out copies. WORTH the $$ in speed, convenience and PEACE of mind. Pardon the loud trumpeting.

Communication is hard. The reps need to be empowered and encouraged to call the customers when necessary. They encourage 300 dpi resolution and under 2 MB PDF file, which is not even possible with our scanner. They made a vague comment about a legal description looking abbreviated but did not explain. They refused to call me. They said the county said "Image is light please darken", but the image looked fine to me. Maybe not their fault, but they refused to help work with the county on that for me. I followed their suggestion though and re-scanned at 300 dpi, but they misunderstood me and did not re-submit it right away. Over 48 hours later, it's still not recorded yet. I hope it will be today.

Really good product, included guide to filling out forms. Totally pleased with that part. Customer service however was terrible. Did not hear back after I sent two emails. The site signed me up but after I was accepted they would not allow me to download a form, with the notation my account was closed. Had to use another email. Had problems with that. Finally got off of site and went to a login site that allowed me to download the forms. If you can get past setting up your account, it is fantastic site. Nice price compared to alternatives. Also I recieved two validation codes. Have no idea why they were sent.
