Arkansas provides no statutory direction for waiving rights of lien; however, it is customary for a claimant (contractor) to record a waiver of lien or partial waiver of lien as evidence of receipt of payment.
Lien waivers act as a sort of receipt, stating that a payment or arrangement for payment has been made by the owner for the potential lien claimant's furnishing of labor, materials, services, or equipment on an underlying contract. Waivers do not release the claimant's future rights to lien for labor, materials, services, or equipment furnished after the date the waiver is signed by the claimant.
A typical waiver of lien rights states contains a description of the subject property and the property's address. It identifies the claimant as the executing party and names the title owner of the property with whom the claimant has contracted. Most importantly, it contains a date up to which the claimant is waiving his right to lien (the execution date).
The waiver is signed by the contractor or individual acting on behalf of the contractor. The waiver does not have to be notarized for it to be valid. Waivers are recorded in the circuit court clerk's office in the county where the property is situated. Before recording, ensure the document complies with the standardized document form act, codified at Ark. Code Sec. 14-15-402.

While it's nice to get all the forms and info in one package for a reasonable cost, the fixed format of the form does not allow for a lengthy meet and bounds property description for real property. Also, the Cover Sheet has big fillable sections with no instructions about what's supposed to go there. I tried the "Contact Us" link, but all it does is spin saying it's trying verify the security of my connection. Looks like I;m going to have to create my own deed in MS Word instead of just filling in the blacks of the PDF file that I downloaded. Bummer!

The service was prompt and attentive to my questions. I would've just appreciated a heads up that I also needed to contact the county directly (and provide contact info) to receive a certified copy of the document (Notice of Commencement) in order to submit the certified copy to the Building Department. This was an extra step that I haven't had to complete before using another eRecording service. Even if this extra step is a result of the county's system. I would still have expected a head's up (since there wasn't any info regarding this on the county's site for eRecording).

The Quitclaim deed seems pretty simple However I wonder if I can fll out the paper as easily as it looks I appreciate very much the sample and the direction for filling out the deed. Now I am in the process of gathering document to fill out the deed and I think only when after everything done, I may have a clear idea how good the Quitclaim Deed is.
