A grant deed in Florida can be used to transfer ownership in property from a grantor to a grantee. An estate or interest of freehold, or an estate for a term of more than one year is created, made, granted, transferred, or released by a deed in writing that is signed by the grantor in the presence of two subscribing witnesses (689.01). The grant deed is not mentioned by name in the Florida Revised Statutes, but it can be used in this state to transfer ownership from one living person to another. In a grant deed, the grantor promises that the title has not been previously transferred to anyone other than the grantee and that there are not any encumbrances on the property, other than those that may be stated in the deed. The grant deed does not offer as much protection as a warranty deed.
To entitle a grant deed to be recorded, it must be signed by the grantor, and the execution of the deed must be acknowledged by the party executing it, and proved by two subscribing witnesses or legalized or authenticated by a civil law notary or notary public who affixes his or her official seal, before the officers and in the form or manner dictated by statute. The notary public may serve as a witness, but must sign the document twice if doing so: both as a notary and as a witness. An acknowledgement made in Florida can be made before a judge, clerk, or deputy of any court; a United States commissioner or magistrate; or a notary public or civil law notary of the state. The certificate of acknowledgement or proof must be under the seal of the court or officer (695.03). If acknowledgements are made out of state or in another country, they must conform to the provisions of 695.03(2) and (3).
Unless a grant deed is recorded according to law, it will not be good and effectual in law or in equity against creditors or subsequent purchasers for a valuable consideration and without notice (695.01). Grant deeds should be recorded with the clerk of the circuit court in the county where the property is located. The priority of documents is determined by the order and time of recording.

This site was easy to use for access to State forms for filing in Montmorency County clerks office. Not only did I find claim form but a sample claim was available for assisting on how to complete your form correctly. Found this so very useful for us (public resident) to fill in the form as a .PDF file that prints out typed form - rather than handwritten entries. There is a fee but your access is always available on internet to this site in the future. Saved me time using this site and My filed form looks professional. You have access to several other forms if needed.

Highly Pleased- Strongly Recommend Deeds.com Long review... sorry:-) Originally I was very skeptical due to the enormous amount of the scams going on now days and the number of online sources that "claim" to provide you with deed forms for free or for a few. Nothing that you need and want done is free. There is always a cost. So luckily I came across deeds.com. This was the only site that appeared to be simple, to the point, and made no crazy promises. So before selecting this site, I did a little more checking around/price checking to ensure I am getting the best price for the product I needed. I even checked Staples and Amazon to find that they do indeed sell these forms but I do not think the products they provide are specific for my state and county. They claim their forms provided are for all states but my state is specific and I prefer to have forms provided by Deeds.com that is based on Indiana statute that Deed.com clearly identifies on each form. Deeds.com price of $20 seemed a little high at first but when I saw the products provided, the $20 cost is more than reasonable and fair. You not only get the deed form specific for my state and my specific "county" but also the other various/supplemental forms that may be required. Being familiar with my state and knowing how tedious and anal my state is on everything, I was pleasantly please to see the info and extra supplemental forms provided. For example, a person new to the State who recently had property deeded to them, would not necessarily know about the Homestead tax exemption provided if property is your primary residents, over 65 exemption etc. I would highly recommend this site for anyone needing these documents because Deeds.com has you covered on any and all forms/info you could ever need! A bonus is that there is one flat fee and not monthly cost that you have to worry about canceling later unless you superficially select a monthly package. I love the fact that Deeds.com is nothing fancy. There is not a bunch of elaborate graphics etc. They only provide what you need and what they provide is very accurate. Deeds.com has a customer for life.

I am still in the trial stage. I am an older lawyer. Any help I can get is worth it. Once you get used to the format and data fill in the deed thing is excellent. Very professional if not a little slow. I have only done three deeds in one state so I will have to see how it goes. I like the product and their attitude towards pleasing the customer.
