Contesting a Mechanic's Lien in Florida
Under Florida law, filing a statutory Notice of Contest of Lien can defend property against a lien. See 713.22 Fla. Stat (2016).
A mechanic's lien, when filed against property, is valid for one year after the recording date. ( 713.22(1)). The lienor can extend that time past one year by filing a lawsuit to enforce the lien prior to its expiration. When a lien is recorded, however, a property owner may file a Notice of Contest of Lien within the one-year period to dispute the lien's validity. This Notice includes the lienor's name and address, details about the recorded lien, the owner's name, and the signing date. It should also meet all state and local formatting requirements for documents submitted for recording.
Once the notice is recorded, the clerk serves it on the lienor at the address in the lien, putting the lienor on notice that he or she must file a lawsuit to enforce the lien within 60 days. This can shorten the enforceability period because once the lienor receives the Notice of Contest of Lien. If the lienor fails to file a lawsuit within the shortened timeframe, it renders the lien invalid.

Not knowing I could down load these forms, I first went to the local recording office thinking I could get info on the forms I needed. I was told that obviously you dont know what you are doing so find someone who does. This snippy clerk obviously didnt know the forms were accessible on line; either that or she was needing to feel her phony superiority.

I am still in the trial stage. I am an older lawyer. Any help I can get is worth it. Once you get used to the format and data fill in the deed thing is excellent. Very professional if not a little slow. I have only done three deeds in one state so I will have to see how it goes. I like the product and their attitude towards pleasing the customer. Glad to have all of the helpful extra information, even though they don't answer all questions for all situations. So, I accessed public records and asked questions at the auditor's office. Also, on my Mac computer, filling out the actual deed form is a challenge because the screen jumps to the last page everytime I try to type a few letters or hit the return key, so I'm rollling back up to the first 2 pages after most keystrokes. A bit annoying. Overall, happy to have these form options are available! There is really no need to wait and pay for an attorney when all the information needed is available via public records. Fill in the blanks!
