A conveyance of real estate in Florida must meet the statutory requirements as set forth in the Florida Revised Code.
Special warranty deeds can be used to convey title to real estate in Florida. This type of deed limits the general covenants of warranty by covenanting only against defects of title arising by, through, or under the grantor. Other covenants, such as the right to convey and a covenant against future encumbrances may be included in the deed.
The execution of a special warranty deed must be acknowledged by the party executing it, proved by a subscribing witness, or legalized or authenticated by a civil-law notary public who affixes his or her official seal in the manner provided by law (695.03). Two witnesses are required for the grantor’s signature; however the notary public may act as a witness, and should sign the deed both as a notary and as a witness. A special warranty deed can be acknowledged in Florida or in another state by any of the officers listed in 695.03 of the Florida Revised Statutes. A certificate of acknowledgement or proof, under the seal of the court or officer taking acknowledgements, should be attached to the deed presented for recording.
A special warranty deed will not be good and effectual in law or in equity against creditors or subsequent purchasers for a valuable consideration and without notice, unless it is recorded according to law (695.01). The priority of documents is determined by the order and time of recording. Special warranty deeds and all other real estate documents are recorded with the clerk of the circuit court in the county where the property is located.

I have one suggestion and couple of question I would think that most TOD's would be from married couples. It would be real helpful to have a example of the I(we) block for married couples. Why would I check or not check the "property is registered (torrents)" Do I need a notarized signature of the Grantee

I bought a Quitclaim Deed package for Fayette County, Kentucky, to transfer my house into a Living Trust that I had set up previously. Creating my Quitclaim Deed was pretty straightforward, using the form, the instructions, and the sample Quitclaim Deed. I signed my Quitclaim Deed at a nearby Notary Public, then took it to the Fayette County Clerk's office to be recorded. The clerk there asked me to make two small changes to the Quitclaim Deed, which she let me do in pen on the spot: * In the signature block for the receiver of the property, filled in "Capacity" as "Grantee as Trustee ______________________________ Living Trust". * In the notary's section, changed "were acknowledged before me" to "were acknowledged and sworn to before me".

Great do it yourself forms (I used the Quitclaim deed). If you think you're going to need a lot of hand holding you might consider hiring an attorney. The guide and general information provided by deeds.com will help if you have some idea of what you are doing and you are willing to research a little. Your mileage may vary but for me, this was a very efficient and economical way to get my quitclaim deed done.

The documents themselves are fine and the information provided with them is helpful. I find the actual processing of the documents, however, to be difficult particularly once the document has been saved. First, I note that the box for the date only allows entry of the last 2 digits of the year. Unfortunately, my download only allows me to enter one of the 2 digits required. When I delete it repeatedly, it eventually allows both digits to be entered but puts them in extremely small text and in superscrypt. I have not found a solution to this problem and am not sure the deed can even be recorded with this problem. Another problem is that if you try to revise the document after you have saved it the curser goes to the end of the line after each key entry. This means that there basically is no way to efficiently save the document for reworking later since you will have to delete everything you have entered in the text box unless you only need to make a single keystroke change or are willing to replace the curser after each entry. Try that with a long property description! Please note that I am using a Mac to prepare my documents and perhaps this is part of an "incompatibility problem". However, I didn't see a disclaimer regarding Mac use and so would expect the documents to perform correctly. Overall, I give the program a "2 star" rating because I am experiencing significant difficulties in entering dates in the documents even before saving them and because saving your work for later revision appears to be basically unworkable.
