Florida recognizes four types of lien waivers, as set forth in FLA. STAT. 713.20. There are two categories of waivers: conditional and unconditional. Both categories include full or partial releases. A full lien release waives the entire lien amount while a partial waiver relinquishes the right to a lien for the amount represented by a progress payment.

Lienors use the unconditional waiver upon final payment to confirm receipt of the final balance due, and to remove the lien against the property. The waiver must include the names of the lienor, the contractor, and the property owner, the legal description of the property where the work or improvement took place, and the amount paid.

The lienor signs and dates the form in front of a notary, then files it in the records of the same county where the original lien was recorded.

I bought a Quitclaim Deed package for Fayette County, Kentucky, to transfer my house into a Living Trust that I had set up previously. Creating my Quitclaim Deed was pretty straightforward, using the form, the instructions, and the sample Quitclaim Deed. I signed my Quitclaim Deed at a nearby Notary Public, then took it to the Fayette County Clerk's office to be recorded. The clerk there asked me to make two small changes to the Quitclaim Deed, which she let me do in pen on the spot:
* In the signature block for the receiver of the property, filled in "Capacity" as "Grantee as Trustee ______________________________ Living Trust".
* In the notary's section, changed "were acknowledged before me" to "were acknowledged and sworn to before me".

EZ to use program....was able to print all forms ordered. I expect to go back to to use recording ability. Instructions are easily followed...would be nice to have confirmation included but they are available to purchase. Hope for successful recording of TOD affidavit.
