Current Lender, holder of the Promissory Note uses this form to cancel a Georgia "Security Deed" (also known as a "Deed to Secure Debt", "Loan Deed" or "Warranty Deed to Secure Debt") when it has been satisfied/paid in full. Record this form with the Clerk of the Superior Court in which the Security Instrument was recorded, the same county that the property lies in. (The clerk shall index and record, in the same manner as the original mortgage instrument is recorded, the canceled and satisfied mortgage instrument or such portion thereof as bears the order of the mortgagee or transferee directing that the mortgage be canceled, together with any order of the mortgagee or transferee directing that the mortgage be canceled. The clerk shall show on the index of the cancellation and on the cancellation document the deed book and page number where the original mortgage instrument is recorded.) (Section 44-14-4)
In general, the Lender has 60 days from satisfaction, to release the Security Deed before he/she becomes liable for damages. See Georgia Code Section 44-14-3

The process was easy going. The process is one thing, the results another. I have attempting to resolve this matter, of claiming sole ownership of the property for several YEARS. I lost my Bride of 65 years in 2015. A lawyer I hired failed in his attempt, so I'm waiting to see the actual results. Your Transfer on Death Deed is fine and you have plenty of information about that part. But where is the Confirmatory Deed that is required in many jurisdictions in order to actually pass ownership of a property when the Transfer on Death Deed becomes effective? IT IS MISSING!!

Order Process: 5 Stars - very easy Material Received: 2 Stars Issues: 1. Printing- Document would not print in format displayed. Format would continually shrink to approx 2/3 size thus not useable for formal doc submission to County Records office. 2. Document Format- Data insertion fields (addresses) were not of correct size for data input. I needed a 4 line input space but was limited to only 3 lines. Also, Date field (year) was mis-oriented in-so-much that the 3rd digit (inputted) overlapped on 2nd digit (pre-printed) and also was of noticeably different font. 3. Useability- Hand-written input space provided (for Notary) was deficient in space and spacing. It was a challenge to utilize the space available to complete fully and maintain legibility. Overall - the document worked marginally as advertised, I did need to re-write the entire document myself. It is a good concept but I'd recommend that Deeds company improve the downloaded forms for actual useability, readability, functionability. regards, Jim S
