Codified at Indiana Code 30-4-4-5, a certification of trust is a document presented by a trustee as evidence of the trustee's authority to act on behalf of a trust.

Lending institutions or other third parties might request a certification of trust before they enter into any transactions with a trustee. Since trust instruments are not recorded, the identities of those with a beneficial interest in the trust remain private. The certification presents only the essential information needed while maintaining confidentiality of personal information a trustee or trust maker may not wish to disclose.

The certification verifies the existence of the trust under which the trustee is named. The document provides basic information, such as the name and date of the trust; the type of trust and who, if any, retains a power to revoke the trust; the identity of the trust's settlor; and the identities of all acting trustees. If a trust has co-trustees, the certification states how many co-trustees are required to sign off on documents relating to the trust, as well as their identities. In addition, the certification provides the name by which the trust is to hold assets.

As with other documents relating to real property, the certification should include a legal description of the subject real estate. The document may be executed and signed by any acting trustee and acknowledged before a notary public. Certifications can be recorded in the county or counties in which the real property is situated.

Finally, the powers of the trustee relevant to the transaction at hand are laid out. A recipient of a certification may request additional excerpts from the trust instrument, such as those which designate the trustee and lay out the trustee's powers to act in the pending transaction, but the recipient can reliably act on the information contained in the certification alone as if it were fact.
Requesting excerpts from a trust instrument opens the requester to certain liability under Ind. Code 30-4-4-5(h).

This is a very useful site for downloading legal forms - just be sure you're getting the form you need before buying. Unfortunately I selected the wrong form initially and had to buy a 2nd form to correct my error. I saw no way of communicating my error at that point - i.e., loss of one star.

The documents themselves are fine and the information provided with them is helpful. I find the actual processing of the documents, however, to be difficult particularly once the document has been saved. First, I note that the box for the date only allows entry of the last 2 digits of the year. Unfortunately, my download only allows me to enter one of the 2 digits required. When I delete it repeatedly, it eventually allows both digits to be entered but puts them in extremely small text and in superscrypt. I have not found a solution to this problem and am not sure the deed can even be recorded with this problem. Another problem is that if you try to revise the document after you have saved it the curser goes to the end of the line after each key entry. This means that there basically is no way to efficiently save the document for reworking later since you will have to delete everything you have entered in the text box unless you only need to make a single keystroke change or are willing to replace the curser after each entry. Try that with a long property description! Please note that I am using a Mac to prepare my documents and perhaps this is part of an "incompatibility problem". However, I didn't see a disclaimer regarding Mac use and so would expect the documents to perform correctly. Overall, I give the program a "2 star" rating because I am experiencing significant difficulties in entering dates in the documents even before saving them and because saving your work for later revision appears to be basically unworkable.

not enough room for legal description. Wouldn't allow me to enter widow status in owner box. Not clear who to send it to so I printed it out and will ask the notary who I use for recording it.
