What is the Kansas Executor Deed with Power of Sale?

When the decedent dies testate (with a will), naming a personal representative (PR) of his or her estate, the PR is called an executor. An executor may need to sell the decedent's real property to raise money to pay the estate's debts or for other reasons in the best interest of the estate.

An order for sale is required before an executor can transfer real property, unless the decedent's will includes a power of sale.

Use an executor's deed with power of sale after the district court has issued an order for sale to convey real property from the estate. In addition to meeting all state and local standards for conveyances of real property, the deed includes a recitation of facts concerning the executor, the decedent, the order for sale, and the subject property being transferred. The executor signs the completed form in the presence of a notary public prior to recording.

Review: I am a lawyer and purchased a specialized type of deed for a special scenario. The product received was functional, but not great. Wording is slightly clunky and the form layout was not convenient for making a professional final product. The wording also didn't contemplate a remote-state probate, which is a common scenario. Something about the PDF prevented me from doing cut and paste, so I had to do OCR to get the relevant text for inserting in my existing draft deed. Finally, while the site claims it is customized for the exact state and county, it does not appear to be well-customized for that purpose and I had to use other language (not sourced from the deeds.com document) to meet local norms.

Review: Delivery of documents was instantaneous once payment is received. Thank you for that. For future clarification to potential users, Deeds.com may want to categorize the type of easement documents that are available. I was needing a 'utility easement' form and received an 'ingress/egress' form. Had I known it was an ingress/egress document, I would not have made the purchase. Outside of this issue, this site is very helpful for the average layperson to hold guardianship over personal interests.

Review: mostly good; however, you need to update the annual exclusion gift amount from $14,000 to $15,000 (where it has ben for several years), and you need to make your Gift Deed final paragraph be gender neutral like "they" or "he or she" rather than just"he".
