An affidavit of descent (alternately, affidavit of heirship) under KRS 382.120 establishes a source of title for a grantor who is transferring property he or she acquired from an intestate estate.

The affidavit must be filed before the grantor can record a deed conveying the subject property. Pursuant to Kentucky statute, the affiant (person making the sworn statements contained within the affidavit) may be the grantor or any one (1) of the heirs at law or next of kin of the ancestor of the grantor, or of two (2) residents of the Commonwealth of Kentucky.

The affidavit must recite the ancestor's name, date of death, and place of residence, as well as information regarding the ancestor's surviving spouse, if applicable. In addition, the affidavit must state that the ancestor died intestate (without a will), and contain a list of the names, ages, and addresses of each of the ancestor's heirs at law and next of kin, and include everyone's relationship to the ancestor and the interest in real property he or she inherited by the ancestor's death.

The affiant must sign the document before a notary public before filing in the office of the county clerk of the county wherein the subject real property is situated.

After some initial general confusion -- (we sold a small piece of land privately and therefore do not typically prepare such documentation (!)) -- we were able to purchase and download all forms from Deeds.com and understand how to complete it/them. The help is all there, we just needed to read and study it - the "Example" helped alot. We were able to complete the Document per your online form(s) and then take it to be signed/notarized - and take the completed paper document to the Registry -- and it is now all registered and we are All Set. To call an affidavit of minor correction a Correction Deed in your descriptions is incorrect. They are two different products. I did not intend to purchase an affidavit. I intended to purchase a Correction Deed.

I was very impressed with the Mineral Deed form, especially with the instructions to fill it out AND a copy of a completed for to compare against. This definitely saved me money for an attorney. The one thing I don't understand, though, is why I could not save the completed Deed to my hard drive. I did have to change a few things after the fact and I had to re-type the entire page to make the corrections. If not for this, I would definitely rate the forms and instructions as a 5 star.
