An affidavit of descent (alternately, affidavit of heirship) under KRS 382.120 establishes a source of title for a grantor who is transferring property he or she acquired from an intestate estate.
The affidavit must be filed before the grantor can record a deed conveying the subject property. Pursuant to Kentucky statute, the affiant (person making the sworn statements contained within the affidavit) may be the grantor or any one (1) of the heirs at law or next of kin of the ancestor of the grantor, or of two (2) residents of the Commonwealth of Kentucky.
The affidavit must recite the ancestor's name, date of death, and place of residence, as well as information regarding the ancestor's surviving spouse, if applicable. In addition, the affidavit must state that the ancestor died intestate (without a will), and contain a list of the names, ages, and addresses of each of the ancestor's heirs at law and next of kin, and include everyone's relationship to the ancestor and the interest in real property he or she inherited by the ancestor's death.
The affiant must sign the document before a notary public before filing in the office of the county clerk of the county wherein the subject real property is situated.

The process for obtaining document itself was easy, and the included guide and example are great! I do have an issue with the format itself, though. The form has pre-defined text boxes, which cannot be altered without partially rebuilding the entire document. For the 'property description' field on the Mineral Deed form, the text box is not large enough for the rather lengthy legal description entered on my original plat. Fortunately, I have a copy of Adobe Pro, so I have been able to re-build the doc to accommodate this short-coming.

Pros, quick purchase and document availability including instructions and examples. Cons, For the cert. of trust, the form would not accept the length of our trust name with no way to get around. The pdf file printing did not meet the requirements for 2.5" top margin and .5" other margins as well as the 10pt font size as the form information was shrunk down even when normal printing.

Holy cow. I was told by several people that getting a deed recorded would take 7-10 days. So I thought I'd give deeds.com a try with their e-filing service. While it's nice to get all the forms and info in one package for a reasonable cost, the fixed format of the form does not allow for a lengthy meet and bounds property description for real property. Also, the Cover Sheet has big fillable sections with no instructions about what's supposed to go there. I tried the "Contact Us" link, but all it does is spin saying it's trying verify the security of my connection. Looks like I;m going to have to create my own deed in MS Word instead of just filling in the blacks of the PDF file that I downloaded. Bummer!
