Real property conveyances are governed by Chapter 382 of the Kentucky Revised Statutes.

Special warranty deeds are statutory under KRS 382.040 and transfer ownership of real property from the grantor (the seller) to the grantee (the buyer) with limited warranties of title. They provide guarantees that the grantor is the true owner of the property, has the legal right to convey it, and will defend the title against any claims originating from the time they owned the property. However, the grantor does not guarantee that there are no other title defects before they owned it, so this type of deed offers more protection for the grantor, and less for the grantee.

A lawful special warranty deed includes the names and addresses of each grantor and grantee. Kentucky requires all recorded documents or documents affecting a change in property ownership to contain information on how the grantee will hold title. For residential property, the primary methods for holding title in co-ownership are tenancy in common, joint tenancy, and tenancy by entirety. A grant of ownership of real estate to two or more persons creates a tenancy in common, unless otherwise specified. Tenancy by entirety is a vesting option available to married couples only (KRS 381.050(1)).

Provide a complete legal description of the property and the source of the current grantor's title. The deed must also include the preparer's name, address, and signature (KRS 382.335), and the in-care-of tax address (KRS 382.110(2)). State law also stipulates either listing the full amount of consideration exchanged for the transfer, or, if nominal or no consideration has been exchanged, the fair cash value of the property (KRS 385.135). The county assesses a transfer tax on the consideration, due at the time of recording, unless the transaction is exempt under KRS 142.050.

Finally, the form must meet all state and local standards for recorded documents, which may vary from county to county. Confirm these requirements with the local recording office.

Both the grantor and grantee must sign the deed in front of a notary for the deed to be recorded (KRS 382.130). Submit the completed deed, along with any supplemental documentation necessary for the specific transaction, to the county clerk's office of the county in which the property is situated (KRS 382.110(1)). Recording preserves the ownership history of the property and provides public notice of the transfer, which protects both the grantor and the grantee from claims based on false information.

I am delighted with the form. I just had to go through so much time and expense in order to use it. First, from your site I downloaded Adobe Acrobat. It totally compromised my computer. I had to get a computer expert to walk me through deleting adobe, and put a substitute on in order to use the form. That was an expense of $60.00. Then after that I still had a hard time getting the program to work, as the substitute program would not accept my e-mail address and I finally had to get someone on line to help me access that. I found it was a $$30.00 charge for the substitute. After fighting these lovely roadblocks, I was finally able to fill in the only form I needed and print it off. Took me two days to accomplish that. Why on earth do you offer adobe when it can compromise a computer so badly? Dealing with my husbands death and then having to deal with this, just one of many deterrents, well let's put it this way, it did not make my two days.

The documents themselves are fine and the information provided with them is helpful. I find the actual processing of the documents, however, to be difficult particularly once the document has been saved. First, I note that the box for the date only allows entry of the last 2 digits of the year. Unfortunately, my download only allows me to enter one of the 2 digits required. When I delete it repeatedly, it eventually allows both digits to be entered but puts them in extremely small text and in superscrypt. I have not found a solution to this problem and am not sure the deed can even be recorded with this problem. Another problem is that if you try to revise the document after you have saved it the curser goes to the end of the line after each key entry. This means that there basically is no way to efficiently save the document for reworking later since you will have to delete everything you have entered in the text box unless you only need to make a single keystroke change or are willing to replace the curser after each entry. Try that with a long property description! Please note that I am using a Mac to prepare my documents and perhaps this is part of an "incompatibility problem". However, I didn't see a disclaimer regarding Mac use and so would expect the documents to perform correctly. Overall, I give the program a "2 star" rating because I am experiencing significant difficulties in entering dates in the documents even before saving them and because saving your work for later revision appears to be basically unworkable.

The site is fine with one exception. About half the pdf files I downloaded were corrupted. I could not open them or view their contents. Fortunately, the link continued to work, so after I discovered this, I downloaded the corrupted files again, and they now seem fine. I do not know if my computer or the website caused this odd problem.

1) I was very pleased when the staff mentioned your service since the three referenced on the Recorder's website all wanted HUGE Account set-up and maintenance fees AND BIG fees per recording, and yours has no set-up fee AND nominal per-recording fee; 2) My (few) recordings will be NON-LAND Related, summary or entire record(s) of Administrative (Procedures Act) records, Other than the Border width and Cover Sheet, do you anticipate any other special requirements for such recording(s)? NOTE: I just sent one by Snail Mail, and they just informed me that due to the GERMIPHOBIA 'Pandemic' the ONLY open and record Snail Mail ONCE A MONTH On the first of each chmonth!
