Property Transfer Affidavit
This form must be filed whenever real estate or certain types of personal property are transferred (even if the deed is not recorded) in order to ensure correct assessment for tax purposes. The new owner must file within 45 days of transfer in the city or township where the property is located. If the form is not filed on time, a penalty of $5/day (maximum $200) applies.
Real Estate Transfer Tax
This form must be filed with the Register of Deeds when the amount paid for the property is not stated on the deed. The form is not required when the amount paid is entered on the deed. The form must be completed and signed by either the seller or his/her authorized agent and submitted in the county where the property is located.

Certain conveyances are exempt from transfer tax. These pages list the county and state exemptions. If the document is transfer tax exempt, the exemption must be stated on the deed. Note that both lists are in content identical until subparagraph (j).

Certificate of Trust Existence and Authority
A certificate of trust existence and authority contains specific information about an existing trust agreement. According to 565.435 of the Michigan Compiled Laws, a purchaser or other party relying upon the information contained in a recorded certificate of trust existence and authority shall be afforded the same protection as is provided to a subsequent purchaser in good faith. Note that under 565.433, only settlor or grantor; an attorney for the settlor, grantor, or trustee; or an officer of a banking institution or an attorney if then acting as a trustee may sign the form if it pertains to real property. Sign the completed form in the presence of a notary, then submit it to the county register of deeds office for recording.

If the property is your principal residence you may qualify for a tax exemption. These forms will help you navigate and apply for a (PRE) exemption.

Use this correction deed to correct an error in a previously executed and recorded deed.
Correction deeds are used to adjust the earlier deed when that document contains minor errors of omission or typographical errors, sometimes called scrivener's mistakes. For example, a misspelled name, an omitted or wrong middle initial, a minor error in the property description, or an omitted execution date. Do not us the correction deed for more substantial changes, such as the removal of a name from a deed. Such alterations are better handled through a quit claim deed.
The correction deed, also called corrective deed, must state that its sole purpose is to correct a specific error, which is usually identified by type. For example: an error in the grantor's name, or an error in the grantor's marital status. It also must clearly reference the type of document it is correcting and state the execution and recording date of that prior document, as well as the number under which it was recorded, either referred to as instrument number or liber (book) and page number.
In subsequent sections, the correction deed repeats the information that was in the prior deed with the exception of the false, ambiguous or omitted information that needs to be corrected. By restating all the information from the earlier deed, this new deed of correction will confirm the previously recorded deed, which remains on record as is.
Warranty deeds require a tax stamp from the treasurer's office before recording. If the prior deed is a warranty deed and the legal description is being corrected, be sure to get a new tax stamp for the current instrument as well. In some counties, any deed that contains the word "warrant" must be checked by the treasurer's office first regardless of the type of correction.

Review: I purchased a Warranty Deed "package" on Friday and found that the Main download was a working document, but the secondary document (which is required) was not. In other words, I was able to use the fill-in feature on the main document, but not on the second document. I used the portal on the website to report my issue the same day. That was Friday. This is Wednesday. I have not heard a word from them and I have to use my documents in 2 days. I will probably have to resort to pen and ink for that document, but I have already tried filling it out twice and have to keep reprinting and starting over. You can't white out or cross out. I would really prefer to have the complete service that I paid for.
