During the construction process, a property owner (or his or her lessee) may ask the contractor for a mechanic's lien waiver in exchange for a full or partial payment.
Michigan defines four permissible types of lien waivers. These include: (1) Partial Unconditional Waiver, (2) Partial Conditional Waiver, (3), Full Unconditional Waiver, and (4) Full Conditional Waiver. M.C.L. 570.1115(9).
Use a full conditional waiver of lien when the claimant receives full payment for his or her contract from the owner, lessee, or designee. M.C.L. 570.1115(4). A waiver of a lien under this section takes effect when a person makes payment relying on the waiver, unless at the time the payment was made, the person making the payment had written notice that the payment or consideration for the waiver has failed (i.e., the check bounced at the bank). M.C.L. 570.1115(6).
Lien waiver forms must be in writing and must comply with Michigan law to be valid. Include the names of the contractor and the property owner, and identify the property and dates covered by the recorded lien.
Lien waivers can be confusing and issuing the wrong type of waiver (or issuing one too early) can result in dire consequences for mechanic's liens. Contact an attorney with questions about waivers or any other issues related to liens in Michigan.

1) I was very pleased when the staff mentioned your service since the three referenced on the Recorder's website all wanted HUGE Account set-up and maintenance fees AND BIG fees per recording, and yours has no set-up fee AND nominal per-recording fee; 2) My (few) recordings will be NON-LAND Related, summary or entire record(s) of Administrative (Procedures Act) records, Other than the Border width and Cover Sheet, do you anticipate any other special requirements for such recording(s)? NOTE: I just sent one by Snail Mail, and they just informed me that due to the GERMIPHOBIA 'Pandemic' the ONLY open and record Snail Mail ONCE A MONTH On the first of each chmonth!

The NV Clark County deed upon death was perfect! Our county doesn't offer a template, but rather has a long list of rules and specifications where they expect you to make your own document. Everything went well except that any information that I typed in on the computer download moves upward so that the letters or numbers are somewhat elevated above the line that should be even with the words on the form. I think it will be acceptable to the county recorder, but I don't especially like to submit things that appear uneven. I asked for help but just received a robotic reply that said to take steps that I already had done. So unless you know a way to correct this I likely won't use your forms again.

It would be helpful if the numbers on the instruction sheet were on the form. I was confused on page two if the signatures were for witnesses or buyer (grantee). I do like the form and will use it in the future. Also page one Grantee's signature only has one line and if there are two buyers need another line.
