A warranty deed with enhanced life estate is sometimes referred to as a ladybird deed. When correctly executed and recorded, this deed provides the structure for a non-testamentary transfer of real property. Leaving the real property out of a will allows the transfer to occur without the need for probate.
The grantor conveys the real estate back to herself, but reserves a life estate with full power to sell, mortgage, change the beneficiary, or otherwise use the property with no penalty for waste or obligation to inform the beneficiary. When the grantor dies, the property rights, if still available, transfer to the default beneficiary.
To finalize the conveyance, the beneficiary must file a property transfer affidavit within 45 days of the grantor's death. Submit the form to the assessor's office located in the same county as the real estate.

Easy to download. Hopefully easy to fill in. Just wish there was wording for a Beneficiary Deed for moving real estate property owned by a married couple to their Trust upon death of last Trustee.

In Colorado a Release of a Deed of Trust without the original note must be efiled - the Recorder said it had to be Simplifile or CSC Global neither of whom are designed to do a 1 off filing (you have to subscribe). Fortunately, I found Deeds.com - they were great. helped me work through a couple clerical issues and it is done. I am so happy and pleased. I would give them more stars if I could. I will spread the word among the realtors and title companies who couldn't help that there is a better option.

it would be nice to have explanation of all the forms required. For a first time estate DPOA, I feel a bit insecure with the forms and would like a paragraph explaining specifics for each link and what to complete for the ladybird deed. I appreciated the fact that the forms were by Texas County and I knew I had the right form. The form were fairly easy to complete. I had trouble completing the form because the property description was long and kept disappearing and I had to re-type. It would also have helped it I could have saved and not had to start over every time.
