A warranty deed with enhanced life estate is sometimes referred to as a ladybird deed. When correctly executed and recorded, this deed provides the structure for a non-testamentary transfer of real property. Leaving the real property out of a will allows the transfer to occur without the need for probate.
The grantor conveys the real estate back to herself, but reserves a life estate with full power to sell, mortgage, change the beneficiary, or otherwise use the property with no penalty for waste or obligation to inform the beneficiary. When the grantor dies, the property rights, if still available, transfer to the default beneficiary.
To finalize the conveyance, the beneficiary must file a property transfer affidavit within 45 days of the grantor's death. Submit the form to the assessor's office located in the same county as the real estate.

This is the first time that I have used this service. Great product. It would be better if the document files were not embedded within other files. It made downloading a little confusing. The titles of the forms did not match exactly word for word, which required a lot of back and forth to make sure I had downloaded the proper document. What would be great is if once you download a document, the hyperlink changed color, or somehow denoted the document had been downloaded. Just a suggestion. You have my email address if you have questions. STILL! Five stars for you guys. I would not let that hiccup dissuade me from buying any form package from you guys. Thanks!

I was able to download the TOD deed form with no issues and it showed immediately. I appreciate that there is a sample provided on how to complete the form. Once downloaded this form is yours and can be changed ,if you make an error. This form is not complicated and is recognized by the County Court House where I filed the document. I wanted to do an Enhancement Life Quitclaim deed and the county government lady didn’t know what I was even talking about.
