Receipt and Waiver of Mechanic's Liens Rights in Minnesota
During the construction process, the owner (or other parties) may make one or more progress or partial payments on the work or materials furnished to date. Additionally, the owner might pay the full amount or the full amount less any retainage or holdback amounts (used to pay subs and other worker's wages). When a full or partial payment is made, you can issue the owner a waiver for a lien on the amount paid. By issuing the waiver, you give up the right to claim a mechanic's lien for either the full or partial payment amount.
The receipt and waiver contains the following information: 1) date drafted; 2) amount received as full or partial payment; 3) a designation as partial payment for labor, skill, and material furnished; payment for all labor, skill, and material furnished or to be furnished; or full and final payment for all labor, skill, and material furnished or to be furnished; 4) if there are exceptions for amounts for retainage or holdback, the total amounts withheld; and 5) a property description; and 6) description of all materials not yet paid for or names of contractors not yet paid.
Finally, you should ensure that the proper box is checked for the waiver type. If a partial or progress payment was made, check Box #1. If a payment is made for all labor, materials or services furnished or to be furnished except for certain retainage or holdbacks, check Box #2. If a full and final payment was made without exceptions, check Box #3.

I am delighted with the form. I just had to go through so much time and expense in order to use it. First, from your site I downloaded Adobe Acrobat. It totally compromised my computer. I had to get a computer expert to walk me through deleting adobe, and put a substitute on in order to use the form. That was an expense of $60.00. Then after that I still had a hard time getting the program to work, as the substitute program would not accept my e-mail address and I finally had to get someone on line to help me access that. I found it was a $$30.00 charge for the substitute. After fighting these lovely roadblocks, I was finally able to fill in the only form I needed and print it off. Took me two days to accomplish that. Why on earth do you offer adobe when it can compromise a computer so badly? Dealing with my husbands death and then having to deal with this, just one of many deterrents, well let's put it this way, it did not make my two days.

The documents themselves are fine and the information provided with them is helpful. I find the actual processing of the documents, however, to be difficult particularly once the document has been saved. First, I note that the box for the date only allows entry of the last 2 digits of the year. Unfortunately, my download only allows me to enter one of the 2 digits required. When I delete it repeatedly, it eventually allows both digits to be entered but puts them in extremely small text and in superscrypt. I have not found a solution to this problem and am not sure the deed can even be recorded with this problem. Another problem is that if you try to revise the document after you have saved it the curser goes to the end of the line after each key entry. This means that there basically is no way to efficiently save the document for reworking later since you will have to delete everything you have entered in the text box unless you only need to make a single keystroke change or are willing to replace the curser after each entry. Try that with a long property description! Please note that I am using a Mac to prepare my documents and perhaps this is part of an "incompatibility problem". However, I didn't see a disclaimer regarding Mac use and so would expect the documents to perform correctly. Overall, I give the program a "2 star" rating because I am experiencing significant difficulties in entering dates in the documents even before saving them and because saving your work for later revision appears to be basically unworkable.
