Use this form to transfer a Deed of Trust to another party. The holder of the Deed of Trust becomes the Assignor and transfers rights to the Assignee, this is usually done when a Deed of Trust has been sold. An Assignment of Deed of Trust (secured by a Deed of Trust or other lien of record, shall be entered on the margin of the record of the lien or said assignment shall be acknowledged and filed for record.) (Except as provided in Section 89-5-37) (89-5-17). [The assignment or transfer of a secured indebtedness need not be filed for record nor entered on the margin of the record if the holder thereof is represented by an agent, trustee or the like disclosed as beneficiary in the mortgage or deed of trust.] [MS Code 89-5-37]

Current Borrowers must be notified of the assignment. Notification consists of contact information of the new creditor, recording dates, recording instrument numbers, changes in loan, etc. Included are "Notice of Assignment of Deed of Trust" forms.

The Truth and lending act requires that borrowers be notified when their Deed of Trust has been sold, transferred, or assigned to a new creditor. Generally, within 30 days to avoid up to $2,000.00 in statutory damages, plus reasonable attorney's fees. Systematic violations can reach up $500,000.00.

It's useful to have forms specific to the County as well as the State. The examples are also helpful, but it would be even more helpful to see an example of a complete and successfully filed package. I will go the County Recorder's Office to see if I can find an example there.

I sent Deeds.com an email with a question, asking for a little guidance as to which form(s) I need, but I'm waiting for a reply. My wife and I own 3 homes (2 in Indiana & 1 in Florida). We are needing to deed each to ourselves and put them into our living trust. I asked Deeds.com to please help by suggesting which forms I need for this. I do not want to get the wrong ones. I have not received a reply yet. When I receive a helpful reply and am able to purchase the correct forms, I am fairly certain my rating will go from 1 to 5. I withhold judgement until later.

This was such a money saver. I was told by someone at the courthouse that I had to have a lawyer prepare the paper work for my mom. They stated that family members couldn't prepare the papers. I was hopeful when I found that I could prepare the survivorship affidavit on Deeds. I was able to prepare everything myself and had no issues today when at the courthouse for all the changes. The program fields should allow the customer to change font size and allow additional space for information to be place on the Deed. Not Bad, still needs improvement.
