(The beneficiary or holder of any deed of trust, including his agents, employees, successors, assigns, attorneys-in-fact or other legal representatives, may appoint a trustee or substitute a trustee, with or without the permission of the mortgagor or mortgagors. This service is excellent. I submitted a Quickclaim Deed so my home would be in the name of a Living Trust I had just created. This was my first attempted at any of this and the staff person, KVH, who reviewed my Deed was extremely helpful and quick to respond to any questions I had and to make sure the Deed had the correct information before submittal to the county for recording. I started the process one afternoon and by the next day, the Deed was submitted to, and recorded in, my county. I will use them again whenever needed.

Was looking for information and forms relating to a trust my parents created, but what I purchased seems geared toward trusts containing real estate only, which is not what I needed. Clearly I missed something prior to purchasing something I can not use. Perhaps additional clarification for us without any experience is this area would be helpful.

The Lady Bird Deed appears to be fine with me as are the instructions. However, there apparently are no specific laws in Texas addressing them other than they are OK. The problem is that lenders are surely going to use them as triggers for their due on sale clauses, especially as the current small mortgage rates begin to increase. The solution to that seems to be to sign and have them notarized, but not to record them unless the holder needs to enforce the provisions. It seems to me that you should consider your solution to that problem in your instructions.
